Allegations Of Counterfeiting Decisions, Constitutional Honorary Council Examines Anwar Usman
JAKARTA - The Constitutional Court's Honorary Council held an examination of Chief Justice of the Constitutional Court Anwar Usman at the office of the institution in Jakarta. Anwar Usman was questioned regarding the case of alleged forgery of the Constitutional Court's decision
"The plan is at three in the afternoon," said Chairman of the Honorary Council of the Constitutional Court I Dewa Gede Palguna when confirmed by ANTARA, Tuesday, February 28.
The examination of Anwar Usman is planned to be held behind closed doors. Earlier on Monday, the Constitutional Court's Honorary Council had examined former Constitutional Justice Suhartoyo.
The examination of Anwar Usman is suspected of being related to the alleged case of falsification of the Constitutional Court's decision on the judicial review lawsuit of Article 23 paragraphs 1 and 2, as well as Article 27 A paragraph 2 of the Constitutional Court.
The lawsuit was filed by Zico Leonard Djagardo Simanjuntak. Zico filed the lawsuit in response to the DPR RI's decision to replace Aswanto as a constitutional judge.
After being tried for about half a month, the panel of judges then read out the verdict on November 23, 2022. The Constitutional Court rejected the lawsuit filed by Zico and his friends.
In the decision, Zico found the difference in sentences between those read by the judge during the trial with a copy of the verdict uploaded on the Constitutional Court website.
In a decision read out by Constitutional Justice Saldi Isra, the ruling reads: "Thus, the dismissal of a constitutional judge before his term of office can only be done because of the reason for resigning at his own request submitted to the Chief Justice of the Constitutional Court...".
Meanwhile, in a copy of the decision uploaded to the Constitutional Court website, the phrase "thus" changes to "in the future".
The change was considered important because it had an impact on whether or not the DPR RI's decision to replace judge Aswanto was valid.
With the alleged case, the Constitutional Court Honorary Council was formed on January 30, 2023 with Chair I Dewa Gede Palguna accompanied by Constitutional Court Judge Enny Nurbaningsih and criminal expert from Gadjah Mada University Sudjito as a member.
