AW 101 Indonesian Air Force Heli Provider Irfan Kurnia Was Sentenced To 10 Years In Prison
Director of PT Diratama Jaya Mandiri Irfan Kurnia Saleh was sentenced to 10 years in prison plus a fine of Rp. 1 billion, subsidiary to 6 months in prison for being proven guilty of corruption in the procurement of the AW-101 Transport Helicopter in the Indonesian Air Force in 2016 with a state financial loss of Rp. 17.22 billion."The trial, stated that the defendant John Irfan Kenway alias Irfan Kurnia Saleh alias Irfan Kurnia had been legally and convincingly proven guilty of committing a criminal act of corruption together. Sentencing the defendant John Irfan with a prison sentence of 10 years and a fine of Rp. 1 billion was replaced with imprisonment for 6 months," said the chairman of the panel of judges Djumyanto at the Jakarta Corruption Court (Tipikor), as reported by Antara, Wednesday, February 22.The verdict is lighter than the demands of the KPK Public Prosecutor (JPU) who demanded that Irfan Kurnia Saleh be sentenced to 15 years in prison plus Rp1 billion, subsidiary to 6 months in prison and the obligation to pay compensation of Rp177,712,972,054.6 subsidiary to 5 years in prison. The panel of judges decided that Irfan Kurnia was only sentenced to a replacement fee of Rp. 17.22 billion."Imposing additional penalties to the defendant Irfan Kurnia to pay compensation of Rp. 17,222,178,271 with the condition that if the defendant does not pay the replacement money, it is safe one month after the decision has permanent legal force, his property can be confiscated by the prosecutor and auctioned off to cover the replacement money. In the event that the defendant does not have sufficient assets to pay replacement money, the convict will be imprisoned for 2 years," said the judge. The panel of judges mentioned a number of aggravating things in Irfan's actions."The aggravating things are that the defendant's actions are contrary to the efforts of the state or government in eradicating corruption. The mitigating thing is that the defendant is polite, has never been convicted and still has family responsibilities," added Judge Djumyanto. The verdict is based on the first indictment of Article 2 paragraph 1 in conjunction with Article 18 of Law Number 31 of 1999 as amended by Law 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.In their consideration, the panel of judges said in the letter of demand that Irfan Kurnia then made an approach to the Assistant for Planning and Budget (ASRENA) of KASAU TNI AU Mohammad Syafei in May 2015 and discussed so that the AW 101 helicopter could be flown to the Indonesian Air Force Anniversary event on April 4, 2016.So on October 14, 2015, Irfan immediately ordered 1 unit of VVIP AW-101 helicopter to AgustaWestland Company, and on October 15, 2015 he paid a final sign of 1 million US dollars or Rp. 13,318,535,000 in the name of PT Diratama Jaya Mandiri to AgustaWestland, even though there was no procurement of VVIP helicopters within the Indonesian Air Force. The helicopter was actually an AW-101 Series Production Number (MSN) 50248 helicopter which was completed in 2012 with a VVIP configuration which was ordered by the Indian Air Force. However, because Irfan had ordered the AW 101 helicopter and had already paid the final sign, Air Force Chief of Staff (Kasau) Agus Supriatna, through the Asrena KASAU TNI AU Supriyanto Basuki, made a proposal for a change in procurement, which was originally the procurement of the VVIP RI-1 helicopter, into a Heavy Transport helicopter, although the specification was only added by Cargo Door on the starboard side with a proposed price of IDR 742,475,410,040.On July 18, 2016, KADISADAU Fachri Adamy then appointed PT Diratama Jaya Mandiri as the winner of the procurement of the AW 101 Transport Helicopter worth IDR 738.9 billion. The panel of judges also stated that there was a command fund (Dako) of Rp. 17,733,600,000."In the trial, it was proven that there was a provision of command funds where the defendant admitted that according to the agreement, 4 percent of the 1st stage payment was Rp. 17,733,600,000, so the amount of payment on September 5, 2016 for the Director of Jaya Mandiri was only Rp. 418,956,300,000 from the value of Phase I of 60 percent of the contract value of Rp. 443,340,000,000 and then Rp. 17,733,600,000 was taken," said the judgeFurthermore, at the B3 Lt. 2 Disku building at the TNI AU Headquarters, Sigit Suwastono handed over the command funds originating from the 1st phase (one) of the procurement of the AW-101 helicopter to Wisnu Wicaksono.Sigit Suwastono on November 9, 2016, created a BRI account for the TNI AU Headquarters Branch which was used as a place to store interest deposits for command funds on behalf of Dewi Liasaroh, a household assistant for BRI employees at the Indonesian Air Force Headquarters branch. Sigit also created a number of deposit accounts.Based on the verdict, both the defendant Irfan Kurnia and the KPK prosecutor expressed their thoughts for 7 days.
