LPSK Puji Hakim's Decision To Bharada E, Become A New History Of The World Of Justice

JAKARTA - The Witness and Victim Protection Agency (LPSK) assessed that the decision of the panel of judges at the South Jakarta District Court against the defendant Richard totaling was a new milestone in the criminal justice world in the country.

"First, the judge clearly referred to the Witness and Victim Protection Act," said LPSK Chairman Hasto Atmojo Suroyo in Jakarta, Friday, February 17, as reported by Antara.

The panel of judges at the South Jakarta District Court sentenced the defendant Richard totaling Pudihang Lumiu or Bharada E to the premeditated murder case of Brigadier Nofriansyah Yosua Hutabarat or Brigadier J.

Together with four other LPSK leaders, Hasto mentioned the legal dilemma experienced by Richard kollaborator or witness perpetrators who work with law enforcement, he is still being prosecuted for 12 years by the public prosecutor in that case.

Due to the legal dilemma that occurred, Hasto said that Law Number 31 of 2014 concerning the Protection of Witnesses and Victims was still a new paradigm in the criminal justice system in Indonesia.

"Including justice collaborators who are new subjects protected by LPSK and regulated in the Witness and Victim Protection Law," he said.

On the one hand, LPSK realizes that not all parties can perfectly understand the paradigm of the criminal justice system. However, the judge progressively gave a decision, one of which is based on the article contained in the Witness and Victim Protection Law.

"This is a milestone of a new history," he added.

On that occasion, Hasto also discussed or answered about doubts whether Richard kollaborator deserved the status of justice collaborator because usually it is only given to perpetrators for criminal cases with a collective dimension or organized crime, such as corruption, criminal acts of trafficking in persons, and narcotics.

However, if you refer to Law Number 13 of 2006 which has been amended into Law Number 31 of 2014, it states that in addition to corruption, trafficking in persons and narcotics, justice collaborators can also be given to criminal cases set by LPSK.

He said that before providing protection, LPSK first conducted an assessment and so on so that Bharada E stated that it was appropriate to give justice collaborators.
