OC Kaligis Handi The Case Ofmining Company Road Access Competition In Central Kalimantan
JAKARTA - The famous lawyer, Otto Cornelis Kaligis or OC Kaligis is known to be handling a mining case in Palangkaraya, Central Kalimantan. His client, Hj Misniati, a Tamiyang Layang resident who was dragged to the court when he actually tried to defend his rights.
Misniati was accused of obstructing the mining business after her land was closed several times. In fact, according to Misniati, the road access closure was because there was no agreement with the mining company regarding the use of her personal route.
Mediation measures have been taken between Misniati and a mining company. But in the end, Misniati was even named a suspect after undergoing an examination at the Central Kalimantan Police, until the file was declared complete or P21 and transferred to the Prosecutor's Office.
Even then Misniati was named a defendant in the trial which took place at the Palangkaraya District Court. This is where OC Kaligis tries to help Misniati to deal with land feuds with mining companies.
According to OC Kaligis, Misniati has a complete letter regarding land ownership which is the source of the feud. The 2,351-meter-long land with a width of 20 meters which is claimed to belong to Misniati is often traversed by trucks belonging to mining companies.
"Actually, the one who closed the road was my late husband, because the road was indeed ours, but it was taken to walk through a mining transport truck, because there was no agreement until it was closed several times. Finally, I asked for it to be resolved amicably, but instead I was reported to the Central Kalimantan Police," said Misniati, written Friday, February 10.
For information, Misniati is the President Director of PT Riyanisa Sekarsari Mandiri (RSM). Misniati also wants to demand her rights to land that has been acquired from the community and then used without permission by mining company PT Rimau Group as a road access.
"The land has been released and compensation for planting grows from the community, which is used by other people without permission. Therefore, I demand that their rights be returned," said Misniati.
OC Kaligis himself can give a statement because the trial is open to the public.
"That's why I can talk now. But I said, if it gets in the way, it means that the road belongs to the company or belongs to the miners, so they object to the road closure. I have also asked BPN, it turns out that the road is not registered by the company developer. It is even acknowledged that the village head, the land belongs to the defendant," said OC Kaligis.
