Tok! Head Of The Former Governor Of South Sumatra Alex Noerdin Disrupts The Supreme Court
JAKARTA - The Panel of Judges of the Supreme Court rejected the cassation filed by former South Sumatra governor Alex Noerdin, a defendant in the corruption case of grant funds for the construction of the Sriwijaya Grand Mosque and the case of the purchase of natural gas PDPDE in 2010-2019.
The rejection applies to the cassation submission from the defendant and the Public Prosecutor (JPU) of the South Sumatra High Prosecutor's Office (Kejati), as stated in the copy letter of Decision Number 7300/I K/Pid.Sus/2022 signed by the Chief Justice of the Supreme Court of the Republic of Indonesia Suharto, as received in Palembang, South Sumatra, Tuesday, February 7, reported by Antara.
Head of the Legal Information Section of the South Sumatra Prosecutor's Office, Mohd Radyan, said that with the rejection of the cassation, Alex Noerdin had to carry out the decision of the Palembang High Court.
To note, the Palembang High Court granted the defendant Alex Noerdin's appeal in September 2022, by setting a reduced prison sentence from a 12-year sentence to nine years in prison.
According to Radyan, the cassation decision must be carried out immediately by the defendant, because there is no term inkrah such as the court's decision at the first instance and appeal.
"Yes, if (the defendant Alex Noerdin) decides to take legal action to review it, the condition is that he must first implement the cassation decision," he explained.
Previously, the Panel of Judges at the Corruption Court (Tipikor) of the Palembang District Court sentenced Alex Noerdin to 12 years in prison and a fine of Rp. 1 billion, subsidiary to six months in prison for a corruption case in the purchase of natural gas by the Regional Mining and Energy Company (PDPDE) in 2010-2019 and grant funds for the construction of the Sriwijaya Palembang Grand Mosque.
The verdict hearing was chaired by the Chief Justice of Yoserizal at the Palembang District Court Corruption Court on Wednesday, July 15, 2022.
During the trial at that time, the Panel of Judges at the Palembang District Court Corruption Court also sentenced three other defendants, namely Muddai Madang, Caca Ica Saleh, and A. Yaniarsah Hasan.
Muddai Madang was found guilty with a prison sentence of 12 years and compensation of Rp36 billion.
Then, Caca Isa Saleh and A. Yaniarsah Hasan were each sentenced to 11 years in prison, including the obligation to pay compensation of Rp. 10 billion for A. Yaniarsah Hasan and Rp. 4.5 billion for Caca Isa Saleh.
They were charged with primary charges of Article 2 paragraph (1) jo. Article 55 paragraph (1) 1 of the Criminal Code, subsidiary to Article 3 jo. Article 55 paragraph (1) 1 of the Criminal Code. The defendants were detained at the Pakjo Class 1 A Detention Center Palembang.
