Why Is Putri Candrawati Only Demanded 8 Years In Prison Despite Knowing Yosua's Murder Planning?
JAKARTA - The defendant Putri Candrawathi was only sentenced to 8 years in prison even though she knew about the planning to kill Yosua alias Brigadier J. The reason for the Attorney General's Office (AGO) was because Ferdy Sambo's wife did not play an active role in murder.
"Then why is the PC being prosecuted for 8 years? This PC is the same as KM in the sense that his active role in criminal law has not done anything," explained Deputy Attorney General for General Crimes (Jampidum) at the AGO Fadil Zumhana to reporters, Thursday, January 19.
Based on the facts of the trial, during the seconds of Brigadier J's execution, the defendant Putri Candrawathi was only in the room. So, he is considered not to be directly involved.
However, it is undeniable that in the indictment, Putri Candrawathi is considered to have knowledge of the planning and murder. Thus, a criminal sanction of 8 years in prison is deemed appropriate to be given.
"But he knew there was a murder plan, so we snared him with 340. From where he knew about the premeditated murder, from the facts revealed in the trial there was a role for him to know, but he did not," he said.
Similar demands were also given to the defendants, Strong Ma'ruf and Ricky Rizal. The reason is similar because they were not actively involved in the murder of Brigadier J.
"That's why we made the cluster, there was an intellectual cadre, there was an implementation of the RE, then there were people who took part in it," said Fadil.
For information, in the premeditated murder case of Brigadier J, there were four defendants. They are charged with different criminal sanctions.
The defendants Ma'ruf, Ricky Rizal, and Putri Candrawati were sentenced to 8 years in prison.
Then, the defendant Richard totaling alias Bharada E was sentenced to 12 years in prison. Then, Ferdy Sambo was sentenced to life imprisonment.
They are believed to be legally and convincingly proven to have violated the primary squad or Article 340 of the Criminal Code in conjunction with Article 55 paragraph 1 to (1) of the Criminal Code.
