"Only One Suspect Fails The Kidney Whose File Has Been Delegated By The Criminal Investigation Unit, That's Still Waiting For The Prosecutor's Examination"
The Criminal Investigation Unit of the National Police has just completed a case file of an acute kidney failure suspect by submitting stage one to the public prosecutor of the Attorney General's Office.
Head of the Public Information Section (Kabagpenum) of the Public Relations Division of the National Police Kombes Pol. Nurul Azizah said investigators handed over the first stage of the case files on PT Afi Farma's corporate suspect to the Public Prosecutor's Office today. "On Monday, January 16, 2023, investigators from the Dittipidter Bareskrim Polri have submitted a case file with a corporate suspect PT AF to the prosecutor," said Nurul, Monday, January 16, as reported by Antara. In fact, investigators named two companies as suspects, in addition to PT Afi Farma, as well as CV Samudera Chemical. In addition, investigators also named two people as suspects, namely the President Director of CV Samudera Chemical with the initials E and his son with the initials AR. Since being named as suspects last November last year, the two suspects have fled. Investigators included both in the wanted list of people (DPO) and published red notices. The suspects are suspected of committing criminal acts of circulating dangerous chemicals eltylene glipol (EG) and deetilen glykol (DEG) who are strongly suspected of causing acute kidney failure in Indonesia.EG/DEG is a compound whose structure is simple, but has a high level of toxicity. This has been regulated in the European Food Safety Agency (EFSA) as well as the Food and Drug Administration (FDA) and have been included in the list of toxic distances so that its use is prohibited in Indonesia. Meanwhile, PG is allowed to use as a solvent substance and carrier for substances that are unstable or cannot dissolve in water. The EG/DEG contamination threshold should be 0.1 percent. But nine drum samples are detected to be up to 52 percent and some are up to 99 percent. This means that, almost 100 percent are the EG/DEG content. In addition, investigators also conduct an examination of three companies as distributors of raw materials instead of pharmaceutical manufacturers with the initials PT TBK, PT FJP and PT APG.
With the submission of the case file for one suspect, it indicates that the investigation process in the police has entered the prosecution stage, but investigators are still waiting for the results of the prosecutor's research whether the case transferred is declared to be formally and materially complete to complete the evidence at trial.
According to the Criminal Procedure Code, the Public Prosecutor has 14 days to examine the case file until it is declared complete (P-21) for further delegation of stage two (suspects and evidence) to the Public Prosecutor.
Currently, there are still three more suspects to be investigated.
Direktur Tindak Pidana Tertentu (Dirtipidter) Bareskrim Polri Brigadier General Pol. Pipit Rismanto belum memberikan tanggapan terkait kendala yang dihadapi dalam menyelesaikan berkas perkara tersangka lainnya.
This case of acute kidney failure in children has attracted public attention, because more than 100 children in various regions in Indonesia have died, allegedly taking sirop drugs containing EG and DEG exceeding the threshold. Meanwhile, the Attorney General's Office when confirmed regarding the submission of stage one of the case files for acute kidney failure, the Attorney General's Office of Legal Information (Puspenkum) stated that it had not received the notification of the delegation of the case in question.
