Hendra Kurniawan Signs The Handy Of A Blank Order In Investigation Of The Death Of Brigadier J
The defendant Hendra Kurniawan was questioned by the public prosecutor (JPU) regarding the signing of an empty warrant (sprin) intended for members of the Paminal Bureau to investigate the death of Brigadier J.
Jakasa's remarks began when he questioned the reason Hendra signed the empty sprin. In fact, the sprin should contain clear orders, from the time limit to the shortest investigation that must be carried out.
"We have also been led, yes, those who signed my warrant have also been studied in the regions to control one province. This means that in order to clear the investigation, there is a time limit so I will not sign a warrant if it is incomplete because of the validity of the investigation warrant, there must be a period of time," said the prosecutor at the trial at the South Jakarta District Court (PN South Jakarta), Friday, January 13.
"Why did you sign the incomplete order earlier?" he continued.
Hendra immediately answered. Instead, he said it was common at the National Police's institution.
"I answered yes, brother of the prosecutor, that's at the District Attorney's Office, I'm in the police. Such things are reasonable and common. So those who fill them are from the reasonable and prevalent executors who schedule the number of letters to be scheduled. Only how many days there are counted," said Hendra.
"Okay, now what was ordered by this investigation letter is still valid. That's still the case. Is it empty? Is it still valid?" said the prosecutor.
"Right, that's right, the one who knows about this problem is Agus Nurpstria," said Hendra.
Hearing this statement, the prosecutor continued to search Hendra Kurniawan. The former Paminal Karo mentioned that the signed sprin was still valid today.
"That's why I asked if it was empty, the time period for the implementation of the lead order that you issued this second is valid?" said the prosecutor.
"Yes, if it is empty like that, but in my opinion it cannot be empty, this is what the legal advisory team has shown," said Hendra.
"This is what I asked, it still applies not to this fact. Because after all it will be based on the order of the defendant OOJ. So what I ask is still valid, it's not until now, even though one of the appointed ones is still a defendant?" said the prosecutor.
"It doesn't apply in my opinion," said Hendra.
The reason Hendra said the sprin no longer applies is because it has now been confiscated by a special team (timsus) formed by the National Police Chief, General Listyo Sigit Prabowo.
"It's no longer valid, the sprin was used when the investigation process was taken by the Timsus and it was no longer implemented," said Hendra.
Hendra Kurniawan was jointly charged with obstructing the investigation into the death of Brigadier J. He is said to have ordered to secure CCTV DVR from around Ferdy Sambo's official residence, precisely at the security post of the Police Complex, Duren Tiga, South Jakarta.
Thus, Hendra Kurniawan is suspected of violating Article 49 in conjunction with Article 33 subsidiary Article 48 paragraph (1) in conjunction with Article 32 paragraph (1) of the ITE Law Number 19 of 2016 and/or the second indictment of Article 233 of the Criminal Code subsidiary Article 221 paragraph (1) to 2 of the Criminal Code in conjunction with Article 55 paragraph 1 to (1) of the Criminal Code.
