9 Regulations Against Supreme Court Last Year, Including Perma 1/2022 Regarding Guidelines For Submission Of Restitution
JAKARTA - The Supreme Court (MA) stated that nine regulations were issued by the Supreme Court during 2022 in order to carry out the generating function.
Chairman of the Supreme Court, Prof. M. Syarifuddin, said that one of the items issued by the Supreme Court Regulation (Perma) Number 1 of 2022 was intended as a guideline for requests for restitution and compensation rights submitted to the court.
"To obtain restitution and compensation rights, it has been determined in various laws and regulations, but has not yet regulated the technical settlement of the application for rights," he said during a virtual reflection of MA's performance in 2022, Tuesday, January 3, was confiscated by Antara.
He explained that Perma 1/2022 regulates the procedures for completing applications and providing restitution and compensation to victims of criminal acts.
The former Deputy Chairperson of the Supreme Court for Judicial Affairs stated that the provisions for restitution are regulated in Government Regulation (PP) Number 43 of 2017 concerning the implementation of restitution for children who are victims of criminal acts, and Article 31 paragraph (4) PP Number 7 of 2018 concerning the provision of compensation, restitution, and assistance to witnesses and victims.
This provision also relates to Government Regulation Number 35 of 2020 concerning amendments to Government Regulation Number 7 of 2018 concerning the provision of compensation, restitution and assistance to witnesses and victims.
The regulation states that further provisions regarding the technical implementation of the examination of restitution applications and compensation are regulated through a perma.
"Therefore, Perma Number 1 of 2022 was issued to provide guidelines for requests for restitution and compensation rights submitted to the court," he said.
