Criminal Expert At Kubu Ferdy Sambo-Putri Candrawati Calls Lie Detector Must Be Put Aside If Breaking The Rules
JAKARTA - Criminal law expert Elwi Danil said that the results of the examination using alie detector cannot be used as evidence of evidence at the evidentiary stage if the process violates the rules.
This view was conveyed by Elwi when answering questions from legal counsel Ferdy Sambo and Putri Candrawathi who questioned the results of the test polygraph which must comply with the rules at the National Police Chief. One of them is about doing it without any procedures.
Then, Elwi's actual polygraph test is still being debated. This is because some people think that this cannot be used as evidence or clues.
"But even so, in the process of finding or processing the results of the polygraph test, of course there are regulations that must be ignored, there is an SOP that must be prosecuted as previously a legal advisor said there was a Perkap Kapolri that regulates how people are examined," Elwi said in a trial at the South Jakarta District Court, Tuesday, December 27.
Then, if the results of the examination are obtained in a way that is contrary to the rule of law, of course it cannot be accepted as evidence.
"Why is that? Because something that is obtained in an incorrect way, against the law cannot be positioned as evidence of the case," he said.
"So if we relate it to the process of finding evidence, if the process of finding evidence is not true then the evidence will also become something that is not true," continued Elwi.
The team of legal advisors who heard the opinion reiterated the views of experts. Especially regarding whether the results of the graph test can be used as evidence.
Until then, Elwi said that the consequences of the examination process that did not comply with the rules were that the results had to be put aside.
"If it is concluded that it is not true because the way to obtain it is against the rules if it is positioned as evidence, of course, he cannot be accepted as legal evidence, he must be ruled out," said Elwi.
Meanwhile, Ferdy Sambo and Putri Candrawathi underwent a polygraph examination or an honesty test during the investigation process. As a result, the husband and wife were declared lying with minus results.
The results of the examination were conveyed by Aji Febriyanto, a member of the National Police in the field of forensic computers who have expertise in the field of polygraphs.
"Macem-macem. Mr. FS has a total value of -8, Putri -25," said Aji.
'Minus, indicated lying. If Putri Candrawathi, it is indicated that she lied," continued Aji.
However, Putri said that during the examination process she was under pressure. Because, he was forced to undergo it even though he was not willing.
