Do Not Find Intention To Be A Reason For The Case File For The Former Director Of LIB Hadian Lukita Was Returned To The AGO

The case file for the former Director of the New Indonesian League (LIB) Akhmad Hadian Lukita was declared incomplete and returned to the East Java Regional Police investigators. The reason is because the mens rea or malicious intent of the person concerned has not been found in the case of the Batch Tragedy.

"The material act that caused many victims has not been found to be related to the cause of the impact between the Director of LIB in his capacity as Director and the crime that occurred in Kanjuruhan," said the Head of the AGO, Ketut Sumedana when confirmed, Friday, December 23.

Thus, the case file was returned by the Attorney General's Office (AGO) because it had not fulfilled the material elements. East Java Police investigators were also asked to complete it again.

"It has not been found that there is a mens rea or malicious intent that causes an incident in Kanjuruhan. The relationship between clauses has not been found by investigators," he said.

The two shortcomings, continued Ketut, have been conveyed in the form of instructions to investigators. With the hope that the case file can be completed as soon as possible and can go up to the trial stage.

Previously it was reported that Akhmad Hadian Lukita was released from the detention cell. The reason is that the detention period has expired but the case file is not complete.

Kasubdit I Kamneg Ditreskrimum Polda Jatim, AKBP Achmad Taufiqurahman emphasized that even though he was not detained anymore, Hadian Lukita was still a suspect.

"The person concerned is still a suspect," said Taufiq.

It is different with the five other suspects in the Kanjuruhan tragedy, consisting of three members of the National Police and two civilians who have been transferred to the East Java High Prosecutor's Office (Kejati) and detained.

"Of course, with this time that has expired, we are obliged to issue (Hadian) first to the suspect in question. Regarding the completeness of the material requirements, later we will continue to complete the deficiencies," he said.
