PKS Secretary General Aboe Bakar Al-Habsyi Is Capable Of Becoming The Guarantee Of Rizieq's Suspension Of Detention

JAKARTA - The PKS Secretary General who is also a member of the Indonesian Parliament, Aboe Bakar Al-Habsy, has stated that he is capable of being the guarantor of efforts to postpone the detention of the leader of the Islamic Defenders Front (FPI) Rizieq Shihab.

Aboe Bakar said that he had conveyed his ability to guarantee the suspension of detention to Rizieq's attorney, where Rizieq is currently being held for 20 days.

"I am ready to be the guarantor for the suspension of his detention, this is certainly in accordance with the provisions of Article 31 of the Criminal Code. Where a suspect can be submitted for a suspension of detention," said Aboe Bakar in his statement on Sunday, December 13.

Pursuant to Article 31UU of the Criminal Code, investigators or public prosecutors or judges, in accordance with their respective powers, can hold a suspension of detention with or without money or personal guarantees, based on specified conditions.

Aboe Bakar explained that the detention suspension can be given on three conditions. First, they will not repeat the suspected criminal act, second they will not eliminate any evidence, and third they will not escape.

"I see that the three requirements can be met by HRS, so investigators should be able to postpone the detention," said the member of Commission III of the DPR.

"However, of course all will return to the investigators, because they have the authority to grant or not the request for a suspension of detention," he continued.

For information, Islamic Defenders Front (FPI) lawyer Aziz Yanuar said that his party was planning to propose a suspension of the detention of Muhammad Rizieq Shihab.

Aziz said there were two reasons why his party wanted to apply for a suspension. According to Aziz, Rizieq's detention could be suspended because Rizieq was cooperative and is still recovering.

"The reason for the suspension is because Habib Rizieq did not run away and his condition is still recovering," said Aziz.

In fact, the Secretary for Legal Aid FPI claimed that the family and the House of Representatives (DPR) RI were willing to take responsibility for Rizieq's suspension.

"The guarantor is the family and the DPR," he said.

In this case, Polda Metro Jaya has named Habib Rizieq a suspect in the alleged violation of the health protocol. In addition, there were five other people who were also named suspects in the alleged violation of protocol at Habib Rizieq's celebration.

Rizieq had scheduled his questioning twice by Polda Metro Jaya. However, at that time he did not come to answer the summons on the grounds of restoring health.

He was charged under Articles 160 and 216 of the Criminal Code. Article 160 of the Criminal Code concerning Incitement to Violence and Not Complying with the provisions of the law, with the threat of six years imprisonment or a fine of IDR 4,500.

Meanwhile, Article 216 paragraph 1 of the Criminal Code concerning Obstacles to Legal Provisions. The threat is imprisonment of four months and two weeks or a fine of Rp9,000.
