Before Becoming A Suspect, Rizieq Shihab Intends To Fulfill Police Summons
JAKARTA - Attorney for the Islamic Defenders Front (FPI) Aziz Yanuar said Rizieq Shihab was due to fulfill the summons in a case of alleged crowd violation and health protocol (prokes) on Monday, December 14. But before this was realized, the police had first named him a suspect.
"Earlier our plan was that if there were no dynamics like this (the suspect was named), Monday would come, together with Habib Rizieq and other witnesses to undergo examination," Aziz told reporters, Friday, December 11.
Aziz said that the plan to attend Rizieq Shihab had actually been communicated to investigators on December 7. At that time, Rizieq Shihab was unable to fulfill the summons for examination because he was still in the recovery period.
Thus, asking investigators to reschedule it again. With a note, Rizieq Shihab will fulfill the summons for examination.
"It has been (communicated) with the investigating superiors. We will come on Monday December 14th," he said.
But with the determination of this suspect, the plan has changed. Aziz said, with the change in the dynamics of this case, his party would meet investigators.
The goal was to take a summons for examination for Rizieq Shihab as a suspect. So, this FPI leader will later fulfill the call.
"Today we take the letter, if the letter is stated, for example, the examination schedule is Wednesday, yes we will come Wednesday, depending on which letter we want to take," he said.
Previously, the police named the high priest of the Islamic Defenders Front (FPI) Rizieq Shihab as a suspect. Determination of the suspect based on the results of the case title.

For the other five suspects, namely, Chairman of the Akad Nikah Committee Haris Ubaidilah, Secretary of the Akad Nikah Ali Alatas Committee, Person in Charge of Security Maman Suryadi, Person in Charge of Akad Nikah Events Ahmad Sobri Lubis, and Head of Akad Nikah Event Section Idrus.
Yusri said that in this case investigators applied a different article to the suspects. Especially for Rizieq, the police used Articles 160 and 216 of the Criminal Code.
"The first is that as the organizer, MRS's own brother is presumed in Articles 160 and 216 (KUHP)," he said.
Article 160 of the Criminal Code contains incitement to committing violence and not complying with the provisions of the law, with the threat of six years in prison or a fine of Rp. 4,500.
Meanwhile, Article 216 paragraph 1 of the Criminal Code concerning Obstacles to Legal Provisions. The threat is imprisonment of four months and two weeks or a fine of Rp9,000.
Meanwhile, other suspects were only charged under Article 93 of Law Number 6 of 2018 concerning Health Quarantine. Under this regulation they are threatened with one year imprisonment or a Rp100 million fine.
