LPSK Please Session Bharada E Next Separated From Other Defendants

JAKARTA - The Witness and Victim Protection Agency (LPSK) regrets the merger of the Bharada E trial with the other defendants in one courtroom at the South Jakarta District Court.

It is feared that this will make Bharada E depressed when giving a statement to the panel of judges.

According to Deputy Chairperson of the Witness and Victim Protection Agency, Edwin Partogi, the premeditated murder case of Brigadier Nofriansyah Yosua Hutabarat or Brigadier J, the defendant Bharada E is a Justice Collaborator (JC) who played a role in uncovering the case.

"We hope that the examination of Bharada E will be separated, because of JC," said Edwin, Tuesday, November 8.

As JC, Bharada E has the right to receive special treatment, for example not meeting with other defendants during the trial or Bharada E undergoing a virtual trial.

"We fully respect the decision of the panel of judges. But we hope that the panel of judges in the process of filing the next defendant so that the examination of Bharada E is separated from other defendants. We understand the workload of the panel of judges who handles so many defendants," he said.

It is feared that Bharada E psychologically feels scared and depressed when giving testimony if it is merged again.

"We hope that special handling will continue to be the concern of the panel of judges so that we can dig deeper, maintain the consistency of honesty and the objectivity of a person who has the status of JC," he said.

As a JC, Bharada E's statement is expected to be able to reveal the roles of each defendant before the panel of judges.

"Disclosure of cases cannot be separated from Bharada E. This disclosure needs honesty," he said.

Previously, the follow-up trial of the premeditated murder case against Nofriansyah Yosua Hutabarat alias Brigadier J with the defendant Richard totaling alias Bharada E was held, Monday, November 7.

The panel of judges decided to combine the trial of the premeditated murder case of Nopriansyah Yosua Hutabarat alias Brigadier J for the defendants Richard totaling alias Bharada E, Ricky Rizal alias Bripka RR, and Strong Ma'ruf.

The combination of the defendant in the follow-up trial of the murder of Brigadier J this time was based on input from the Public Prosecutor (JPU). The reason for the merger was because the witnesses to be presented were the same.

"The plan for Monday's trial will be in conjunction with the case of defendant KM and defendant RR," said a member of the prosecutor's team, Paris Manalu.

In this case, Bharada E, Bripka RR and Strong Ma'ruf were jointly charged with Ferdy Sambo and Putri Candrawathi committing premeditated murder against Brigadier J.

As a result of their actions, they were charged with violating Article 338 of the Criminal Code, subsidiary to Article 340 of the Criminal Code in conjunction with Article 55 paragraph 1 of the Criminal Code.
