DPRD Makzulkan Regent Of Jember Faida But Rejected By The Supreme Court
JAKARTA - The Supreme Court rejected the request for the right to test the opinion of the Jember DPRD to impeach the Jember Regent Faida. The Supreme Court assessed that the mistakes made by the first female regent in Jember had been corrected.
Supreme Court spokesman Andi Samsan Nganro said the panel of judges' consideration was that Faida had followed up on the recommendations of the Minister for Administrative Reform and Bureaucratic Reform, the Minister of Home Affairs, the State Civil Apparatus Commission and the Governor of East Java after violating administrative provisions.
"Thus the proposal to dismiss the Regent of Jember from the Jember Regency DPRD has no legal grounds," said Andi Samsan Nganro as reported, Tuesday, December 8.
The case that was submitted to the Supreme Court on November 16, 2020 was examined by Supreme Court Judge Supandi, Is Sudaryono and Yodi Martono Wahyunadi.
Previously, the Regent of Jember Faida was judged to have violated his oath and promise of office and violated a number of provisions in the legislation so that the seven factions in the Jember DPRD agreed to propose a dismissal.
The Jember DPRD in submitting the file to the Supreme Court also includes 33 pieces of evidence that are considered strong to impeach the regent who will compete again in the 2020 simultaneous regional elections from an individual route.
Meanwhile, the provisions for the dismissal of regional heads or deputy regional heads are regulated in Law Number 23 of 2014 concerning Regional Government, among which the dismissal of regional heads can be proposed to the president based on the decision of the Supreme Court on the DPRD's opinion that the regional head has violated the oath of office promise, does not carry out obligations.
