YLBHI: Allegations Of Human Rights Violations In The Tragedy Of The Malang Stadium
JAKARTA - General Chairperson of YLBHI Muhamad Isnur responded after seeing a riot video at the Malang Regency Office, East Java which occurred on Saturday night, October 1. Muhamad suspects that in the event of the Malang Stadium there are indications of alleged human rights violations.
Based on what he saw in the video, Isnur suspected that excessive use of force with tear gas was the cause of many fatalities. The tear gas, continued Isnur, resulted in the large number of supporters in the stands jostling to find the exit, shortness of breath, fainting and colliding.
"This is exacerbated by the overcapacity of the stadium and the big match which was carried out at night. All interested parties must carry out a thorough investigation and evaluation of the match," Isnur said, Monday, October 3.
Isnur further said that the use of tear gas was prohibited by FIFA. FIFA in the Safety and Security Regulation Stadium Article 19 emphasized that the use of tear gas and firearms is prohibited from securing the crowd in the stadium.
We consider that the actions of the apparatus in this incident are contrary to several regulations such as: Perkapolri No. 16 of 2006 concerning Guidelines for crowd control, Perkapolri No.01 of 2009 concerning the Use of Forces in Police Action, Perkapolri No.08 of 2009 concerning Implementation of Principles and Standards of Human Rights in the Implementation of the Duties of the Indonesian National Police, Perkapolri No.08 of 2010 concerning Regulations for Cross-Replaced Control and How to Act in Contravention of Huru-hara and Perkapolri No.02 of 2019 concerning Control of Huru-hara.
"We consider that the handling of the apparatus in controlling the potential period for alleged human rights violations with the death of more than 150 fatalities and hundreds more injuries," he said.
YLBHI also criticized the repressive actions of the apparatus in handling supporters by not heeding various regulations, especially the implementation of the principles of human rights of the Police.
"YLBHI urges the State to immediately investigate this tragedy which resulted in 153 fatalities and injuries by forming an independent investigative team. Kompolnas and Komnas HAM to examine alleged human rights violations, alleged violations of professionalism and performance of police officers on duty," he said.
YLBHI also urged the Propam Polri and Pom TNI to immediately examine allegations of violations of professionalism and the performance of TNI-Polri members on duty at the time of the incident.
"YLBHI urges the National Police Chief to conduct a strict evaluation of the tragedy that occurred which claimed lives both from the supporters and the police. The Central and regional governments must be responsible for the loss of life and injuries in the tragedy of Kanjuruhan, Malang.
