Mahfud MD Do Not Want To Join The Mixed About Aswanto Who Was Removed By The DPR
JAKARTA - Coordinating Minister for Political, Legal and Security Affairs Mahfud MD admitted that he did not want to interfere with the dismissal of the judges of the Constitutional Court (MK) Professor Aswanto by the Indonesian House of Representatives. Because according to him, the removal is part of the procedure in the DPR.
"I don't know the mechanism in the DPR, I won't interfere," said Mahfud at the Pancasila Sakti Monument, Lubang Buaya, East Jakarta, Saturday, October 1. "In that law there are three rooms, the Constitutional Court. From the DPR, from the government and from the Supreme Court. I don't know the mechanism in the DPR, I don't know either, at the Supreme Court, which we will process so that there are no surprises," he continued.
Even so, Mahfud said, the government would study the positions of three judges in the Constitutional Court. Including, making a mechanism if there is a change later.
"But the government itself, of course we will learn. Because there are three of them from the government, they will learn. At least they will make a mechanism if there is a change in the government," he said.
In terms of constitutional law, added Mahfud, the public office decision made by the DPR is not the government to appoint. Therefore, the government cannot interfere with the Council's decision.
"But formalizing the term law, inaugurating it means that the president should not question the reason. But we'll see the progress, the president can't," he explained. "If it's from the government, we can talk about it later. Because this is new and a bit sudden so we don't know either and we realize that we have to make this mechanism," Mahfud added. Previously, Commission III of the DPR revealed the reason for replacing Aswanto with Guntur Hamzah as a Constitutional Court Judge (MK) which was ratified in yesterday's plenary meeting. In fact, Aswanto will only enter retirement in 2029.
Chairman of Commission III of the DPR RI, Bambang Wuryanto or Bambang Pacul, said that Aswanto's removal from the position of judge of the Constitutional Court was a political decision in response to the presence of a letter from the country's top institution. "Let's just answer that we want to replace people," said Bambang at the Senayan Parliament Complex, Jakarta, Friday, September 30. Bambang said that Aswanto was not extended as a judge of the Constitutional Court because of his disappointing and inconsistent performance.
"Of course it's disappointing," said Bambang. Aswanto, who is the judge of the Constitutional Court from the DPR's proposal, is actually considered not to reflect the attitude of the DPR in carrying out its duties.
"Yes, what if the DPR's products are disallowed by him, he is his deputy from the DPR, right. If you propose someone to be a director at home, you are the owner, then your policy is not in accordance with the directors, it's a owner, that's how, after all. Right, it's difficult for us," explained Bambang.
