BANDAR LAMPUNG - Two defendants in the corruption case of school operational assistance funds (BOS) in Central Lampung Regency were sentenced to six years in prison.

"Requesting the panel of judges to impose prison terms on the two defendants, namely Riyanto and Erna Susiana with a sentence of six years," said the Public Prosecutor (JPU) from the Central Lampung District Attorney's Office Faris Afifty during a trial at the Tanjungkarang District Court, Bandar Lampung. , August 24.

The prosecutor also asked the panel of judges to impose a fine of Rp. 200 million, subsidiary to six months in prison and to pay compensation for state losses to the defendant.

"Paying the replacement money that has been enjoyed by both of them jointly or jointly amounting to Rp.4,644,006,672, subsidiary to imprisonment for two years and six months," said Faris.

In the trial, Iskandar, the legal adviser to the defendant Erna Susiana, expressed his objection to the claim for payment of state losses which were paid jointly and severally. "We object to the payment of state losses being paid jointly and severally," he said.

In addition, the lawyer also said that the prosecutor's indictment against his client in the alleged corruption case of BOS funds was vague.

On the next point, Iskandar also asked the panel of judges that his client be acquitted of all the charges that were indicted by the prosecutor.

The actions of the defendant Riyanto, former Head of Basic Education at the Central Lampung Education and Culture Office and Erna Susiana as a partner began when the Ministry of Education and Culture distributed Affirmation BOS and Performance BOS funds to 195 schools in Central Lampung in 2019.

At that time, Defendant Erna met with Riyanto to introduce an electronic system for procurement of goods and services from the Ministry of Education and Culture named Siplah to school principals.

"In the meeting, Kusen agreed to Erna's request on the condition that there was no coercion and it was an absolute right for each school," Kusen said as conveyed by the prosecutor in his indictment.

Furthermore, the defendant Erna socialized to the school principal that his company could help provide goods. Erna also asked for the account/password of each school principal to be used for ordering and the school sent funds to Erna's company. In total there were 163 schools that ordered through Erna.

From October 2019 to January 2020, Erna spent Rp. 9,018,955,000 for items needed for Affirmation BOS and 2019 Performance BOS.

Based on the Decree of the Minister of Education and Culture of the Republic of Indonesia Number 31 of 2019 concerning Technical Instructions for Affirmation and Performance BOS (AFKIN), the allocation of funds is used to finance the provision of learning home access facilities in the form of tablets, PC computer equipment, laptops, projectors, wireless network devices, external hard drives with product specifications. which has been set.

"For the distribution of goods to the sub-districts, the defendant Erna along with his subordinates, namely Alex, Ardi, Fadli, Dimas, Erwin, Roni, Revi, Supri, and Aris. Then from the results of the examination of the team of ICT experts at the University of Lampung, tablet devices, computers, network devices wireless, and the projector specifications do not match the Permendikbud reference. Then there is no DVD room and wifi dongle installed on the computer. Then there are three of 18 laptops with different serial numbers, the laptop does not come with a Microsoft Windows operating system software CD, "he said.

"As a result of the defendant's actions in the procurement process that did not comply with the technical specifications that have been determined in accordance with the audit report in the context of calculating state losses, the total state financial losses amounted to Rp.4,644,006,672," said Prosecutor Faris.

In that case, both were charged with Article 2 paragraph (1) and Article 3 Juncto Article 18 paragraph (1) letters a and b paragraph (2) and paragraph (3) of the Law on the Eradication of Criminal Acts of Corruption in conjunction with Article 55 Paragraph (1) to -1 Criminal Code.
