Fadel Muhammad Takes Legal Path After Being Replaced From MPR Leader
JAKARTA - DPD member Fadel Muhammad said his removal as MPR leader from the DPD element which was decided in the DPD plenary meeting on Thursday (18/8) was unconstitutional. Fadel will take legal action.
"The mechanism for the motion of no confidence does not exist in the laws and regulations, is not in accordance with the rules and regulations in the DPD and MPR. So, all forms of proposals or what is termed 'takeover of the mandate' by a number of DPD members are unconstitutional," he said. Fadel in a written statement reported by ANTARA, Friday, August 19.
He explained that his position as Deputy Chair of the MPR for the 2019-2024 period was legal according to the applicable laws and regulations.
According to Fadel, he has worked and carried out his duties in accordance with the mandate of the legislation, including carrying out Article 138 paragraph (1) of the Regional Representative Council (DPD) Regulation on Orders (Ordinances) which mandated him to submit a performance report before the DPD Plenary Session.
"The steps taken by a number of DPD members who are not in accordance with the rules of law and statutory regulations, are included in the category of actions that do not carry out the oath or promise of office that have been uttered, as well as the obligation as members of the DPD to obey Pancasila, the 1945 Constitution, and applicable laws and regulations," he said.
Therefore, Fadel will report the members who signed his impeachment to the DPD RI Honorary Board (BK), the State Administrative Court (PTUN), and civil and criminal court lawsuits.
The senator from Gorontalo said that he was currently preparing all the legal reports with his team of attorneys as a form of fighting non-compliance with the law and all applicable laws and regulations.
"We must not allow arbitrariness in this country, especially in high state institutions. I will take all legal efforts to fight non-compliance with the law and all applicable laws and regulations," he said.
Previously, the DPD Plenary Meeting on Thursday (18/8) night decided Tamsil Linrung as a candidate for leadership of the MPR from the DPD element to replace Fadel Muhammad.
"From the voting results, Senator Tamsil Linrung received the most votes to become a candidate for the leadership of the MPR RI from elements of the DPD RI," said Deputy Chairman of the DPD RI Nono Sampono at the DPD RI Plenary Meeting at the Parliament Complex, Jakarta, Thursday (18/8) night. .
Nono explained that the voting process was attended by 96 DPD members with 93 valid votes, one abstention, and two invalid votes.
According to him, in the voting process, Tamsil received 39 votes, Bustami Zainudin 21 votes, Yorrys Raweyai 19 votes, and Abdullah Puteh 14 votes.
