This Is The Chronology Of The Case Of Timothy Tandiokusuma Until The Supreme Court Rejects The Prosecutor's Cassation

JAKARTA – Recently, the public spotlight has focused on the alleged money laundering case (TPPU) reported by SF against the reported person, Timothy Tandiokusuma, CEO of a private equity company called Black Boulder Capital.

SF invested an amount of Rp. 13.2 billion in Timothy through Black Boulder Capital, but as the COVID-19 pandemic in Indonesia progressed, the money did not return. Interestingly, the case that ended with the filing of an cassation by the Public Prosecutor (JPU) in the Supreme Court was finally won by the reported party.

Sumarso, Timothy Tandiokusuma's attorney, explained the chronology and problems of the case that had caught the public's attention. According to him, this case began several years ago. At that time, SF, who was the reporter, invested up to Rp. 13.2 billion in Timothy. SF knows Timothy as the son of Tan Aditya Tandiokusuma, a successful property entrepreneur who has built several high-end housing estates in Surabaya.

In addition, Timothy is also known by SF as a foreigner who owns 15 companies and assets of up to Rp1 trillion and is a cousin of David Widodo, his uncle. With the assets owned by Tmothy, SF believes that it will be safe if anything happens to its investment.

Unfortunately, at the beginning of 2020, the COVID-19 pandemic hit Indonesia for almost the past two years and had an impact on almost all sectors including Timothy Tandiokusuma's business, which is engaged in private equity.

“From the start, I was convinced that the complaint from the complainant who led this case on allegations of fraud and/or money laundering offenses against our client was incorrect. The case alleged by the complainant was misdirected because there is no criminal element and only debt and credit issues that can be resolved amicably," said Sumarso in a written statement, quoted on Friday, August 19.

Sumarso added that before this case was started, Timothy actually had good intentions to resolve this case amicably. Therefore, Timothy offered peace money of Rp. 19 billion, including the Rp. 3 billion that had been received by the complainant.

"The reported party (Timothy Tandiokusuma) offered peace by preparing a total of Rp19 billion, including Rp3 billion of which the complainant had received, but the complainant refused because he insisted on asking for another Rp21 billion, or peace money worth a total of Rp24 billion," Sumarso explained.

However, an amicable path was not reached because the complainant insisted on continuing this case to the court and reported Timothy to the Tangerang District Court on suspicion of fraud and money laundering offenses in 2020. Then after a year, on August 10, 2021, the panel of judges decided to acquit the defendant Timothy Tandiokusuma of all charges and released from all legal charges.

Disagreeing with the decision of the Tangerang District Court, Public Prosecutor (JPU) Desi Novita filed an appeal to the Supreme Court with its decision No.951K/pid.sus'/2022 dated March 23, 2022.

The whistleblower still insisted on asking for compensation worth a total of Rp. 24 billion, even though the material loss of the complainant was actually only Rp. 13.2 billion. Even in the court process, the complainant when asked by the judge admitted that he had received the initial peace money of Rp. 3 billion.

“The appeal filed by the public prosecutor (JPU) was rejected. So the motivation of the complainant is very clear to force the will to bring this case to a criminal case so that our client pays what the complainant wants," said Sumarso.

Meanwhile, Timothy is very grateful because for more than a year this case has greatly disrupted his life and now with the rejection of the prosecutor's appeal by the Supreme Court, his life has begun to calm down.

"I am very grateful that there is permanent legal force from the Supreme Court where this case is not a criminal case. This is all thanks to the prayers and support from family and friends who have always given moral support until this case is over,” said Timothy.
