Musician Deolipa Yumara Former Bharada E Lawyer Seriously Sues Kabareskrim Et Al With Rp15 Billion Compensation, Trial Held September 7
JAKARTA - The South Jakarta District Court has accepted a civil lawsuit filed by Deolipa Yumara, a former legal adviser to Bharada E, the suspect in the shooting of Brigadier J, the first trial is scheduled for Wednesday, September 7.
"The First Session is Wednesday, September 7, 2022, at 9:00 a.m. Western Indonesia Time," said South Jakarta District Court Public Relations Officer Haruno as quoted by ANTARA, Tuesday, August 16.
The lawsuit was registered at the South Jakarta District Court on Tuesday (16/8) with Case Number: 753/Pdt.G/2022/PN JKT.SEL to clarify the case for a civil lawsuit against the law.
The plaintiffs are Deolipa Yumara and Muhammad Burhanudin, both of whom are legal advisors to Bharada Richard Eliezer Pudihang Lumiu or Bharada E whose power of attorney was revoked on August 10, 2022.
Meanwhile, the defendants are Richard Eliezer Pudihang Lumiu (defendant I), Ronny Berty Talpesy, new lawyer Bharada E (defendant II), then the Chief of Police casu quo (Cq) or in this case Kabareskrim Polri (Defendant III).
Haruno said the South Jakarta District Court had appointed a panel of judges who would lead and oversee the trial, namely Siti Hamidah as the presiding judge, and Elfian and Anry Widyo Laksono as member judges.
In the lawsuit (petitum) the plaintiff is asking the panel of judges to declare the letter of revocation of power of attorney dated August 10, 2022 on behalf of Richard Eliezer Pudihang Lumiu as defendant I null and void.
The Plaintiff also asked the panel of judges to declare that the revocation of power of attorney by Defendant I and Defendant III in making the letter of revocation of power was carried out in bad faith and against the law.
The plaintiff requested that the panel of judges cancel any form of power of attorney to the legal advisor/advocate concerned as legal advisor to Richard Eliezer Pudihang Lumiu in the case of Brigadier Joshua's death and declared invalid.
The plaintiffs also asked the judge to state that the plaintiff was Bharada E's legal adviser and had the right to defend himself until the trial.
The plaintiff also asked the panel of judges to punish the defendants jointly and severally to pay a lawyer's fee of Rp. 15 billion.
Deolipa Yumara, who is also known as a musician, said that his party demanded that he and Muh Burhanuddin remain as legal counsel for Bharada E in the shooting case of Brigadier J. And demanded that they have the right to defend Bharada E until the court.
"Today we have submitted a lawsuit against the law, from my red and white lawyers Deolipa Yumara and Muhammad Boerhanuddin. So we are filing a lawsuit against the three defendants, defendant I Richard Eliezer Pudihang Lumiu, defendant II Ronny Talapessy, a lawyer who claims to be a lawyer The new one is Richard Eliezer and the third defendant is Kabareskrim," said Deolipa at the South Jakarta District Court, Jalan Ampera Raya, South Jakarta, Monday (15/8).
Bharada E for the second time changed lawyers or legal counsel. Previously, his legal advisor, Andreas Nihot, was appointed by Ferdy Sambo's legal team.
Nihot resigned from his legal adviser to Bharada E last Saturday (6/8). Then the Bareskrim Polri investigators appointed new legal advisers on August 6, 2022, namely Deolipa Yumara and Muh Burhanuddin.
On Wednesday (10/8) Bharada E made a letter of revocation of power of attorney against his team of legal advisers, Deolipa Yumara and Muh Burhanuddin. And replacing lawyer Ronny Berty Talpesy who was appointed by the parents and family of Bharada E. Bharada E was named the suspect in the shooting of Brigadier J, along with Inspector General Ferdy Sambo, Bripka Ricky Rizal and Strong Maaruf.
The four were charged with Article 340 of the Criminal Code, subsidiary to Article 338 in conjunction with Article 55 and Article 56 of the Criminal Code, with the threat of a death penalty, or life imprisonment or a maximum of 20 years.
