Customers Who Lost IDR 5.8 Billion Win A Lawsuit At The Appeal Level Of The Kudus High Court
KUDUS - A Bank Mandiri customer from Kudus Regency, Central Java, who lost money in a Bank Mandiri savings account worth Rp. 5.8 billion won a lawsuit against the state-owned bank on appeal at the Central Java High Court.
"With the issuance of an appeal decision, the Central Java High Court upheld the Kudus District Court's decision on the Bank Mandiri case," said Kudus District Court spokesman Rudi Hartoyo as quoted by ANTARA, Tuesday, August 16.
He revealed that the decision on the appeal case number 59/Pdt.G/2021/PN Kds had been issued on August 15.
With the strengthening of the Kudus District Court's decision, the consideration of the Kudus District Court's decision in deciding the case filed by the plaintiff named Moch Imam Rofi'i who is a customer of Bank Mandiri Kudus was approved by the Kudus High Court.
"It is different when the Central Java High Court judges itself, then the Kudus District Court's decision can be annulled. In this case the Central Java High Court does not cancel the decision, only strengthens the Kudus District Court's decision," he said.
Bank Mandiri as the defendant still has legal remedies for the decision, by making an appeal.
"The defendant can still file an appeal to the Supreme Court within 14 days after receiving a copy of the decision from the Central Java High Court," he said.
If there is no legal remedy, then the decision on the case has permanent legal force or inkrah, so that the applicant or plaintiff can file for execution through the head of the court.
In accordance with the decision of the Kudus District Court, it stated that the lawsuit was partially granted. Furthermore, the court's decision stated that the defendant or Bank Mandiri had committed an unlawful act.
Then, punishing the defendant to pay for the losses suffered by the plaintiff, for the burglary of the plaintiff's account amounting to Rp5.8 billion. The defendant in the decision was also stated to pay the court fees incurred in this case amounting to Rp399,500.
The Plaintiff's attorney, Nur Sholikin, said that he was grateful that the appeal at the Central Java High Court confirmed the Kudus District Court's decision.
"As the facts of the trial were revealed, they should be strengthened. It is undeniable that our client Moch Imam Rofi'i was proven to have lost money in his savings account due to the negligence of Bank Mandiri," he said.
If Bank Mandiri filed a cassation, Nur Sholikin said it would follow the existing procedures by preparing a counter-cassation.
