KPK Confiscates Rp25 Billion Petrol Pump Owned By PT Nindya Karya And Tuah Sejati

JAKARTA - The Corruption Eradication Commission (KPK) confiscated gas stations belonging to PT Nindya Karya and PT Tuah Sejati worth Rp25 billion. The confiscated assets were located in Gampoeng Pie Village, Meuraxa District, Banda Aceh.

"The Corruption Eradication Commission's team of prosecutors has received approval from the panel of judges for the confiscation determination and has carried out the confiscation determination," said Acting KPK Spokesperson for Enforcement, Ali Fikri, to reporters, Tuesday, August 16.

The assets in the form of gas stations owned by the two companies were revealed in the trial at the Corruption Court. Ali said the gas station has an area of 263 square meters.

The gas station, continued Ali, is equipped with facilities such as two buried tanks and buildings and equipment; six units of monitoring wells; up to 1 unit of Hino brand tanker truck.

With this confiscation, the KPK hopes that there will be a snaring effect on the perpetrators of corruption. In addition, it is hoped that there will be an optimization of income for the state treasury.

"So that the eradication of corruption actually provides usability because the asset recovery results will later become one of the PNBP as a source of financing for national development," he said.

Previously, PT Nindya Karya and the private company PT Tuah Sejati were each required to pay a fine of Rp. 900 million related to the corruption charges of the Sabang Unloading Pier construction project in the 2006-2011 fiscal year which caused a loss of state finances of Rp. 313.345 billion.

"Declare that defendant I PT Nindya Karya (Persero) and Defendant II PT Tuah Sejati have been legally and convincingly proven guilty of committing a criminal act of corruption as stated in the primary indictment," said KPK public prosecutor Agus Prasetyo at the Corruption Court (Tipikor) Jakarta was reported by ANTARA, Thursday, August 4.

The Public Prosecutor continued, "The defendant I PT Nindya Karya (Persero) and Defendant II PT Tuah Sejati in the form of a fine of Rp900 million each."

The two corporations were also charged with additional criminal penalties in the form of payment of compensation. "Sentencing PT Nindya Karya (Persero) with an additional penalty in the form of paying compensation to the state in the amount of Rp. 44,681,053,100.00. Stipulating that the amount of Rp. 44,681,053,100.00 that had been confiscated from the defendant was calculated as payment of replacement money," added the prosecutor. .

Meanwhile, PT Tuah Sejati was also charged with additional criminal charges in the form of paying compensation to the state in the amount of Rp49,908,196,378.00.

"Stipulated that Rp9,062,489,079.00 and the assets of Defendant II PT Tuah Sejati which had been confiscated were calculated as a deduction from the replacement money," said the prosecutor.

The KPK prosecutor also requested a stipulation that PT Tuah Stjati continue to manage business assets in the form of public fuel filling stations (SPBU), fisherman's fuel filling stations (SPBN), and LPG bulk transport filling stations (SPPBE) as well as continuing to deposit profits from business assets to a holding account. The Corruption Eradication Commission of the Republic of Indonesia until the decision has permanent legal force.
