Disapproved Of Being Accused Of Being A Student Of A Class Of Students, MSAT Defendant Alias Mas Bechi Challenges The Reporter Of The Oath Of Mbahalah
SURABAYA - The accused of sexual abuse of female students, the defendant Moch Subchi Azal Tsani (MSAT) alias Bechi, does not accept that he is being charged with the sexual abuse of female students. To prove it, the son of a well-known kiai in Jombang challenged the complainant to take an oath of mubahalah.
"Come on, I challenge the mubahalah oath to prove it," said Mas Bechi shortly after the trial at the Surabaya District Court, Monday, August 15.
The challenge of MSAT alias Mas Bechi is aimed at proving whether or not the obscenity alleged to him is true or not. In Islam, the Mubahalah Oath is an oath in the name of Allah SWT. Whoever denies the truth, through the oath is believed to be cursed by Allah SWT.
Today's inaugural offline session lasted nearly nine hours, starting at around 09.00 WIB to 16.00 WIB. In the trial with the agenda of examining witnesses, only one of the five witnesses who have undergone examination.
"Four other witnesses will be examined the following day, Thursday and Friday tomorrow," said the Public Prosecutor who is also the Head of the Jombang District Attorney's Office (Kajari), Tengku Firdaus.
In general, according to him, the testimony of the reporting witness did not contradict the indictment prepared by the prosecutor. Unfortunately, he was reluctant to explain the details of the testimony because the trial was closed. "The material should not be leaked. What is clear is that the testimony supports our indictment," he said.
MSAT was present at the trial for the first time after the Surabaya District Court panel of judges at a hearing last week granted the request for MSAT's legal team to be present during the trial process.
According to him, the offline trial will be reviewed if disturbances arise, especially if they have the potential to spread COVID-19.
In this case, MSAT alias Mas Bechi was charged with three articles, namely Article 285 of the Criminal Code concerning rape with a maximum penalty of 12 years imprisonment.
Then Article 289 of the Criminal Code concerning obscene acts with a maximum penalty of 9 years and Article 294 of the Criminal Code paragraph 2 with a 7-year sentence in conjunction with Article 65 paragraph 1 of the Criminal Code.
