KPK Has Ambition To Drag Surya Darmadi To Trial, Here's The Reason
JAKARTA - The Corruption Eradication Commission (KPK) has confirmed that it is still trying to bring the owner of PT Duta Palma Group, Surya Darmadi, who is still at large, to trial. This step is different from the Attorney General's Office, which opens the opportunity to carry out hearings in absentia or without attendance.
Plt. KPK Spokesperson for Enforcement, Ali Fikri, said this step was taken because Surya was named a suspect for giving bribes. Meanwhile, the Attorney General's Office named him a suspect in corruption that caused state losses.
"(At the KPK, ed) he is suspected of being a bribe giver. So we are not talking about state losses. In-absentia can be done if in the end there is confiscation of the proceeds of corruption from the state's losses," said Ali to reporters at the KPK Rupbasan Building. , Cawang, East Jakarta, 10 August.
This is the reason why the KPK will not try Surya Darmadi in absentia. As a bribe, he must be held accountable for his actions.
"For the giver (bribe, ed) is there a replacement money? No. Now this has made the KPK so far not take the in-absentia option because the article on bribery is different from article 2, article 3, which can confiscate assets," said Ali .
The Attorney General's Office said it had prepared a scheme to try Surya Darmadi in his absence or in absentia. He is currently believed to be in Singapore.
"We'll see, we have a time limit for the handling process, the SOP, if it's difficult to present it later, we will be in absentia," said the Deputy Attorney General for Special Crimes (Jampidsus) at the Attorney General's Office, Febrie Adriansyah, to reporters, Tuesday, August 2. , night.
However, he emphasized, this scheme does not mean the AGO will use Surya Darmadi's repatriation effort as the last step.
However, currently the AGO already has a legally binding decision to extradite the suspect. "In absentia, it will not be removed later to be able to repatriate him, in fact it already has a decision, the legal force is still stronger, to be able to ask for his extradition," said Febrie.
The Attorney General's Office previously named Surya Darmadi as the owner of PT Duta Palma Group as a suspect in the alleged corruption in the seizure of 37,095 hectares of land in Riau. He was named along with another suspect, Raja Thamsir Rahman who is a former regent of Indragiri Hulu.
Meanwhile at the KPK, Surya Darmadi has been named a suspect since 2019. This determination was made after investigators developed a case against former Riau Governor Annas Maamun.
