Transporting Luggage To Airport, Female Dutch Caucasian Businesswoman Owner Of Bungalow In Lombok Deported From Bali Due To Overstay 461 Days
BADUNG - A female Dutch citizen (WNA) with the initials VM (68) was deported by Bali Immigration officers. A Caucasian who runs a restaurant business and owns a bungalow in Lombok, West Nusa Tenggara (NTB) was deported for overstaying his residence permit, aka overstaying 461 days in Bali.
Head of the Ministry of Law and Human Rights (Kemenkum HAM) Bali Anggiat Napitupulu said that VM was deported by the Denpasar Immigration Detention Center team in accordance with Article 48 Paragraph (1) of Law Number 6 Year 2011 concerning Immigration.
"Every foreigner who is in the territory of Indonesia is required to have a residence permit. So, in this case immigration takes immigration administrative action in the form of deporting the Dutch citizen with the initials VM," he said, in a written statement, Wednesday, July 20.
The Dutch woman was deported using KLM Royal Dutch Airlines. This foreigner was deported through I Gusti Ngurah Rai International Airport, Bali with the destination of flying Amsterdam.
Anggiat explained that the Dutch Caucasian woman VM lived in Indonesia, precisely on the island of Lombok for 8 years and 3 months, since April 22, 2014.
VM's purpose in coming to Indonesia is to invest and build a business engaged in the food and restaurant sector and it is also known that this foreigner has a bungalow in the Central Lombok area.
This female Caucasian for the first time entered the territory of Indonesia using a social visit visa and stayed for 6 months. Next, VM reapplys for an investor visa because he has started a bungalow business. This foreigner is registered as an investor's Limited Stay Permit Card (KITAS) holder which is valid until October 23, 2020.
Since the expiration of the limited stay permit, the Dutch foreigner VM no longer extends the immigration stay permit until the time VM is arrested by the officer.
"The person concerned did not extend his residence permit because according to his confession, he had applied for a Permanent Stay Permit Card (KITAP) by asking his fellow Indonesian citizens for help in 2018, but until now it has not been completed," said Anggiat.
After that, in December 2021, officers from the Immigration Division of the NTB Ministry of Law and Human Rights came to check passports. This Caucasian admitted that he just realized his passport had been lost but did not report the loss of the passport to the embassy of his country.
In this case, the Immigration Office Class I TPI Mataram, NTB stated that this foreigner did not have a passport while the immigration stay permit had expired on October 23, 2020.
"Although he argues that this is due to negligence, immigration can still carry out immigration administrative actions in the form of deportation and deterrence in accordance with applicable regulations," said Anggiat.
In the process, because the deportation could not be carried out, the Immigration Class I TPI Mataram office handed over the VM to the Denpasar Immigration Detention Center (Rudenim) on July 7, 2022 for detention and deportation was sought.
After being detained for almost two weeks, VM was finally deported, escorted by three Denpasar Rudenim officers to board the flight to Amsterdam. These Dutch Caucasians will be included in the deterrence list to the Directorate General of Immigration.
"After we report the deportation, the decision on further deterrence will be decided by the Directorate General of Immigration by looking at and considering all the cases," said Anggiat.
