The Job Creation Law Reaps Controversy, Menkumham: For Me A Breakthrough To Advance The Nation
JAKARTA - Law Number 11 of 2020 concerning Job Creation officially applies. Since the document appeared on jdih.setneg.go.id, many people have highlighted the writing errors of a number of articles in the Omnibus Law.
In fact, objections continued to be voiced, especially from the workers and students. Because there are several articles that are considered detrimental to society. However, said the Minister of Law and Human Rights, Yasonna Laoly, for her the Job Creation Law was a breakthrough to advance the nation.
"We may have different opinions, but for me (the Job Creation Law) is a big leap and creative breakthrough to advance the nation," said Yasonna in a written statement, Tuesday, November 3.
Yasonna said this breakthrough occurred because of the president's strong determination with a forward-looking vision, and the support of the DPR, including by a number of other stakeholders.
"Apart from the various controversies surrounding the discussion, the Job Creation Law is very reformative and phenomenal. For the first time we use the omnibus law method comprehensively for a law," said Yasonna.
The PDIP politician said that the Job Creation Law was needed to reduce overlapping regulations, eliminate the potential for licensing corruption, create business conveniences, increase labor-intensive and capital-intensive investment, and create business legal certainty.
"This law is designed to be able to transform the economy and increase national economic growth, which in turn increases large employment opportunities," he explained.
As previously reported, President Joko Widodo (Jokowi) officially signed the Omnibus Law on the Work Creation Law on Monday, November 2 and promulgated in Law Number 11 of 2020.
The government has also officially uploaded a copy of this law via the jdih.setneg.go.id site. The number of pages in the Job Creation Law is 1,187 pages.
There is a writing error in the text of Law 11 of 2020 concerning Job Creation, which is contained in Article 6 of the Job Creation Law which reads:
Improvement of the investment ecosystem and business activities as referred to in Article 5 paragraph (1) letter a includes:
a. application of risk-based business licensing;
b. simplifying the basic requirements for Business Licensing;
c. Simplification of sector business licensing; and
d. simplification of investment requirements
Article 5 paragraph 1 letter a is not in the Law signed by Jokowi. Because there is no derivative verse in the article which reads as follows:
The scope as referred to in Article 4 covers the legal fields regulated in the relevant laws.
