The Need To Investigate Sprinkling Sprinklers On The Bribery Case Of KPU Commissioner Wahyu Setiawan

JAKARTA - During a talkshow, member of the Indonesian House of Representatives Commission III of the PDI-P Faction Masinton Pasaribu suddenly showed an investigation warrant (Sprinlidik) related to the bribery case that ensnared the General Election Commission (KPU) commissioner Wahyu Setiawan and PDIP candidate Harun Masiku.

The leak of the letter made the Freedom of Information Network Indonesia Coalition (FOINI) ask the Corruption Eradication Commission (KPK) Supervisory Board to investigate who leaked the letter to Masinton.

"The KPK Supervisory Board must trace the actor who provided Sprinlidik information on behalf of Wahyu Setiawan to Masinton Pasaribu," said Wana Alamsyah, a researcher at the Indonesia Corruption Watch (ICW) who is also part of FOINI in his written statement, Friday, January 17.

Wana said, sprinlidikt is not information that can be accessed by the public. Based on Law Number 14 of 2008 concerning Openness of Public Information Article 17 letter a, this action has criminal legal consequences and has other implications for cases currently being handled by the KPK.

"Referring to that article, the actions that Masinton have taken are suspected of being able to obstruct the investigation and investigation process or endanger the safety and life of law enforcers," said Wana.

He added that the leak of letters regarding the process of handling cases at the KPK at both the investigation and investigative level, was not the only time this happened. FOINI noted that there were four cases where information had been leaked to the public. These four cases are the first draft of an investigation warrant (Sprindik) on behalf of Anas Urbaningrum in the corruption case of the Hambalang project.

After it was busy, the KPK responded by forming an ethics committee to carry out investigations. As a result, the then KPK Chairman Abraham Samad and his secretary Wiwin Suwandi were fired for violating the code of ethics.

"Second, Sprindik on behalf of Jero Wacik as Minister of Energy and Mineral Resources related to the bribery case in the SKK Migas environment. Third, Sprindik on behalf of Rachmat Yasin as the Regent of Bogor regarding the permit issuance case in Bogor. Fourth, Sprindik on behalf of Setya Novanto as Chairman of the DPR related to the PON case in Riau, "he explained.

Later, after investigating the leakage of the investigation by the KPK Supervisory Board, Wana also asked them to immediately report those caught leaking the classified information.

"The KPK Supervisory Board as an interested party must report the parties suspected of leaking Sprilidik information to the police," he stressed, adding that this reporting could use the criminal law mechanism as regulated in the applicable law.

Looking for the novel Yudi Harahap, the sprinlidik leak

Masinton Pasaribu claimed to have received a copy of a sprinlidik from a man whose name was Novel Yudi Harahap on Tuesday, January 14 at around 11.00 WIB at the Parliament Complex, Senayan, Central Jakarta.

Chairperson of the KPK Employees Forum Yudi Purnomo Harahap said that during the 13 years of working at the anti-corruption agency, there was no one named Novel Yudi Harahap. Yudi, who is also an investigator at the institution, only smiled when he heard about Yudi's name that had come out of Masinton's mouth.

"I just smiled when the news circulated in the online media that there was a foreigner named Novel Yudi Harahap who submitted a sprinlidik document to the table of Commission III member of the DPR RI Masinton Pasaribu," Yudi told reporters in his written statement, Thursday, January 16.

Novel Yudi Harahap's name, which seems to combine his name with Novel Baswedan's senior investigator, raises questions. This is because there is an impression that Masinton is trying to combine his name with the name Novel.

"His name is almost similar to my name Yudi Purnomo Harahap but there is no novel in front of my name," he said.

Yudi said that on the date of giving the Sprinlidik Masinton, he was out of town to carry out a task.

"I do not know what the motive of this person who claims his name is similar to mine," he said.

In addition, Yudi stated that he was not involved as an investigator or investigator in the alleged bribery case against Wahyu Setiawan.

"If my statement is needed by the KPK chief to be confronted with Bang Masinton, then I am willing," he concluded.
