Judge Sentence 2 Defendants Corruption Gili Air Pier Project In North Lombok 16 Months In Prison

MATARAM - The panel of judges sentenced two defendants to corruption in the dock construction project in the tourist area of Gili Air, North Lombok Regency, West Nusa Tenggara, each for 16 months in prison.

The two defendants are Slamet Waloejo, director of a supervisory consulting company from CV Karya Mahardika 97 and his team leader Luqmanul Hakim.

Chairman of the Panel of Judges, Kadek Dedy Arcana, in the trial at the Mataram Tipikor District Court, read out the first verdict for the defendant Slamet Waloejo.

"I hereby declare that the defendant Slamet Waloejo has been legally and convincingly proven guilty of violating the subsidiary charges by imposing a sentence of 1 year and 4 months in prison and a fine of Rp. 50 million," said Dedy Arcana in Mataram, Antara, Wednesday, June 22.

If the defendant is unable to pay the fine within a month from the date the decision has permanent legal force, continued Dedy Arcana, the defendant must replace it with one month's imprisonment.

In the decision stating that Slamet Waloejo was proven to have violated the subsidiary charge of Article 3 Juncto Article 18 of Law of the Republic of Indonesia Number 20/2001 concerning Amendments to Law of the Republic of Indonesia Number 31/1999 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph 1 of the Criminal Code, the judge does not charge to pay for state losses.

However, the judge will consider the existence of a safe deposit of Rp50 million for the prosecutor's investigator as part of an effort to recover state losses which amounted to Rp782 million from the 2017 work contract value of Rp6.28 billion.

The decision for Slamet Waloejo is also in line with the prosecutor's demands, both in terms of criminal penalties and fines as well as the payment of compensation for state losses.

After hearing the verdict, Slamet Waloejo said that he had not been able to make a decision. Likewise with the public prosecutor represented by Budi Tridadi.

On the agenda of the second trial, the verdict for the defendant Luqmanul Hakim who acts as an expert from the project supervisory consultant.

The judge stated that Luqmanul Hakim's actions were proven to have violated the subsidiary charges by sentenced to 16 months in prison and a fine of Rp. 50 million, subsidiary to one month in prison.

Luqmanul was also not charged compensation for state losses. However, the Rp75 million that had been deposited with investigators was considered by the judge to be part of efforts to recover state losses.

For Luqmanul Hakim's decision, this is lower than the prosecutor's demand for two years in prison with a fine of IDR 50 million, subsidiary of 3 months in prison. After listening to the judge's statement, Luqmanul stated that he accepted the decision, while the prosecutor's office responded by stating that he was still thinking about it.

In the description of the verdict of the two defendants, the dock construction project in the Gili Air tourist area at the Department of Transportation, Maritime Affairs and Fisheries of North Lombok Regency, Luqmanul Hakim who was authorized by the Director of CV Karya Mahardika 97, Slamet Waloejo, as the project supervisor expert was declared to have been negligent in Duty.

The statement was also in accordance with the prosecutor's demands, which referred to a study by construction experts regarding the findings of a lack of work volume and overpayment.

The audit results also found potential state losses with a value of Rp. 98.138 million for the volume of work that is less and overpayment which includes three work items with a value of Rp. 684.238 million.

Luqmanul Hakim together with Slamet Waloejo as a supervisory consultant revealed that they had agreed to the change in the volume of the erection work which was not based on a technical review or contract addendum.

Luqmanul Hakim together with Slamet Waloejo also published a recapitulation of the progress of the work which stated that it had reached 100 percent weight, but in fact the work had not been completed.
