Tanjungpinang District Court Judge Orders Bauxite Mine Corruption Defendant To Be Detained

TANJUNGPINANG - The panel of judges at the Tanjungpinang District Court, Riau Islands (Kepri) decided to detain the defendant in the case of corruption in the production operation mining permit (IUP-OP) of the bauxite mine in Bintan, Ferdy Yohanes at the second trial.

"The Panel of Judges asked the Public Prosecutor (JPU) to detain the defendant of corruption, Ferdi Yohanes. At the first trial, Monday (14/6), the defendant has not been detained," said Public Relations of the Tanjungpinang District Court Isdaryanto, quoted by Antara, Monday, June 20.

He said that the Panel of Judges reasoned that the corruption case was included in the category of extraordinary crime, so they deemed it necessary to detain the defendant Ferdi Yohanes in the Tanjungpinang detention house.

"Then, the Panel of Judges considers the objective and subjective requirements, as specified in Article 21 Paragraph 1 and Paragraph 4 of the Criminal Procedure Code," he said.

Meanwhile, Head of the Intelligence Section of the Tanjungpinang District Attorney's Office (Kejari) Dedek Symarta Suir said that his party immediately put the defendant Ferdi Yohanes into the detention center, Monday afternoon, after the verdict from the panel of judges.

The decision to detain the defendant, he said, was the authority of the Tanjungpinang District Court Judge.

"The defendant was detained for the next 30 days to undergo further legal processes," said Dedek.

The defendant Ferdi Yohanes was charged with committing a criminal act of corruption together with other defendants/convicts, in the misuse of IUP OP bauxite mines in Bintan Regency in 2018-2019.

The defendant's act of offering and asking for rent from protected forests to be mined, has resulted in assets belonging to the state being released from state ownership illegally with the issuance/issue of IUP OP for sale to business entities that are not in accordance with the correct mechanism.

In this case, the defendant Ferdi Yohanes is also suspected of having harmed the state's finances in the amount of Rp. 7.5 billion for receiving leases from protected forest lands to a number of mining companies who had previously been convicted of a crime.
