The Expert Said, The Wahyu Setiawan Case Leads To Fraud

JAKARTA - A legal expert from Trisakti University, Yenti Garnasih, assesses the case that ensnared the General Election Commission (KPU) Commissioner Wahyu Setiawan as leading to fraud. This was confirmed by promises that Wahyu never fulfilled before being caught by the KPK.

This claim was strengthened by the position of Harun Masiku, who had not yet been appointed as a member of the DPR to replace Rizky Aprilia.

"I see this as more of a fraud, there are parties who lure Harun Masiku with a request for certain money to become a member of the DPR. But in fact, to this day the decision has not changed, ”Yenti told reporters, Thursday (16/1/2020).

Yenti explained, the KPU in deciding which candidates to be elected or PAW must be carried out collectively and collegially. According to the statement of the KPU commissioner, Pramono Ubeid Thantowi, in a plenary meeting on January 6, 2020 it was decided that the request to appoint Harun Masiku as a member of the DPR to replace Rizky Aprilia could not be granted.

"So far, I see this case as an individual. "Because the decisions in the KPU are collective collegials, it is impossible for Wahyu Setiawan to change his own decision on decisions that have been made jointly with other KPU commissioners," he said.

Due to this incident, Yenti is worried that it will erode public confidence in the election organizers.

"The case that ensnared Wahyu Setiawan is very concerning, especially ahead of the 2020 Pilkada," he said.

"And very coincidentally, this case coincided with the emergence of the Jiwasraya corruption case. Is this really a coincidence? "Of course the people don't want to be obscured over the corruption case," he said.

Wahyu, who is currently detained at the Guntur Pomdam Jaya Guntur Prison, South Jakarta, was caught in a joint silent operation and was named a suspect in receiving bribes along with his trusted confidant, namely Agustiani Tio Fridelina (ATF) who is a former member of the Election Supervisory Agency (Bawaslu).

In addition to determining Wahyu and Agustiani, the KPK also named two other suspects as givers of bribes. They are Harun Masiku (HAR) who is a candidate from the PDI Perjuangan in the 2019 Pileg from the South Sumatra I electoral district and Saeful who is called a private party but is suspected of being one of the party's top staff.

In this case, Wahyu allegedly asked for Rp900 million to appoint Harun as an interim replacement to replace Nazarudin Kiemas, a candidate who died. This transaction was carried out in two stages in the middle and end of December 2019.
