Kompolnas Hopes That The Review Of The Ethics Commission's Decision Related To AKBP Brotoseno Will Be Sped Up

JAKARTA - The National Police Commission (Kompolnas) expects National Police Chief General Listyo Sigit Prabowo to immediately review the decision of the Indonesian National Police Code of Ethics (KKEP) against AKBP Raden Brotoseno.

"With the ratification of Police Regulation Number 7 of 2022, it is hoped that the National Police Chief can review the Brotoseno KKEP decision," said Kompolnas member Poengky Indarti, quoted by Antara, Friday, June 17.

He said Article 83 of Police Regulation (Perpol) Number 7 of 2022 regulates the review (PK). This is not regulated in Perkap No. 14 of 2011 and Perkap No. 19 of 2012.

In this regulation, the National Police Chief has the authority to review the KKEP decision or the appeal KKEP decision which is final and binding. The review is carried out no later than 3 years since the KKEP decision or the KKEP decision is appealed.

It is known that the trial of the Police Professional Code of Ethics against AKBP Raden Brotoseno which was held in October 2020, was only subject to a demotional transfer of duties and asked to apologize to the Bhayangkara Corps leadership.

For this reason, Poengky hopes that the National Police Chief will immediately review the ethical decision trial of AKBP Brotoseno considering the ethical trial decision in 2020.

"That's right (immediately)," said Poengky.

Kompolnas welcomes the National Police Regulation Number 7 of 2022 concerning the Professional Code of Ethics and the Indonesian National Police Code of Ethics Commission which revokes the National Police Chief Regulation Number 14 of 2011 concerning the Polri Code of Ethics and the Perkap Number 19 of 2012 concerning the Organization and Work Procedure of the Polri Code of Ethics Commission.

"With the ratification of this perpol, it will be used for reviewing the KKEP decision or the KKEP appeal decision if it is seen that there are errors and/or evidence that has not been examined," said Poengky.

According to Poengky, Perpol Number 7 of 2022 can fulfill the expectations of the public who have reacted and questioned the firmness of the Polri institution in terms of eradicating corruption.

He said the public had recently reacted strongly to criticism related to the absence of dismissal of AKBP Raden Brotoseno even though his criminal case was already committed and found guilty of accepting bribes and had already served a prison sentence. With the ratification of Perpol 7/2022, it is hoped that the National Police Chief can review the Brotoseno KKEP decision," said Poengky.

To conduct a review, the National Police need to form a team and KKEP PK involving the Inspectorate for General Supervision of the Police (Itwasum), the Human Resources Staff of the Police, the Professional and Security Division of the Police (Div Propam), and the Legal Division of the Police.

The team will conduct research within a maximum period of 14 working days from the issuance of the warrant. The National Police Chief can then form KKEP PK after suggestions and considerations from the team as stated in Article 84 paragraph (4).

The organizational structure of the KKEP PK consists of a chairperson held by the Deputy Chief of Police, Itwasum as deputy chairman, and the members are the Head of the Propam Division, the Head of the Legal Division, and the Assistant to the National Police Chief for SSDM.

The instructions for implementing the PK KKEP are regulated in CHAPTER VI of the KKEP Review from Article 84 to Article 90.
