The Attorney General's Office Transfers Paniai's Human Rights Case Files To The Makassar District Court
JAKARTA - The Public Prosecutor of the Directorate of Serious Human Rights Violations Jampidsus The Attorney General's Office has transferred the case files for the defendant IS in the case of alleged gross human rights violations in Paniai, Papua, in 2014 to the Human Rights Court of the Class IA Special Makassar District Court.
"Today, Wednesday, June 15, 2022, the public prosecutor is transferring the case file against the defendant IS to the Human Rights Court at the Makassar Special Class IA District Court," said Head of the Attorney General's Office for Legal Information (Kapuspenkum) Ketut Sumedana, quoted by Antara, Wednesday, June 15.
Kapuspenkum explained that the incidents of gross human rights violations that occurred in Paniai, Papua were due to the absence of effective control from military commanders who were legally (de jure) and in fact under the power and control of the accused IS.
The IS defendant did not prevent or stop the actions of his troops and also did not hand over the perpetrators to the competent authorities for investigation, investigation, and prosecution, as referred to in Article 42 paragraph (1) of Law Number 26 of 2000 concerning the Human Rights Court.
"As a result of this incident, four people died and 21 people were injured," said Sumedana.
In this case, said Kapuspenkum, the Attorney General has issued the Attorney General's Order Number: Prin-41/A/Fh.2/05/2022 dated May 23, 2022 and appointed 34 prosecutors as a team of public prosecutors to resolve gross human rights violations in the Paniai incident. in Papua Province in 2014.
"So 34 public prosecutors have been appointed," he said.
The delegation of the a quo case files based on the Letter of Delegation of Cases for the Ordinary Examination Procedure Number: B-08/F.5/Fh.2/06/2022 dated June 9, 2022 with No. Reg. Case: PDS-01 / PEL.HAM.BERAT / PANIAI / 05 / 2022, No. Re. Evidence: RB-01 / HAM / PANIAI / 05 / 2022, where the indictment is compiled cumulatively, namely the first violation of Article 42 Paragraph (1) letters a and b Jis Article 7 letter b, Article 9 letter a, Article 37 of the Law Number 26 of 2000 concerning the Human Rights Court, and the second indictment of violating Article 42 Paragraph (1) letters a and b Jis Article 7 letter b, Article 9 letter h, Article 40 of Law Number 26 Year 2000 concerning the Court of Human Rights.
"After the submission of the a quo case files, the public prosecutor will then wait for the determination of the trial date from the Human Rights Court at the Makassar Special Class IA District Court," said Ketut.
It is estimated that one week after the submission there will be a determination of the trial day from the court.
The Paniai incident occurred on December 8, 2014. When civilians were protesting about the beating of the TNI officers against youths at Karel Gobai Square, Enarotali, Paniai. The incident resulted in fatalities, namely four people died and 21 people were injured.
The Paniai incident is one of 13 cases of gross human rights violations that have been investigated by Komnas HAM.
