Proven Corruption, Former ESDM Ministry Official Sentenced To 4 Years In Prison

JAKARTA - Former official of the Ministry of Energy and Mineral Resources (ESDM), Sri Utami, was sentenced to 4 years in prison plus a fine of IDR 250 million, subsidiary to 3 months in prison for being proven to have carried out several fictitious procurements in 2012 that cost the state IDR 11,124 billion.

"The trial declared that the defendant Sri Utami was proven legally and convincingly guilty of committing a criminal act of corruption jointly and continuously. Sentencing the defendant with a prison sentence of 4 years and a fine of IDR 250 million which if not paid was replaced with imprisonment for 3 months", said the chairman of the panel of judges, Toni Irfan, at the Jakarta Corruption Court as reported by Antara, Tuesday, June 14.

Sri Utami was proven guilty of committing an act based on Article 3 of the Law in conjunction with Article 18 No 31 of 1999 as amended by Law 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code in conjunction with Article 65 paragraph 1 of the Criminal Code.

"Requires the defendant to pay replacement money of IDR 2.398 billion to the state no later than 1 month after the court's decision has permanent legal force and if it is not paid, the property can be confiscated and auctioned by the prosecutor and in the case, the defendant does not have sufficient assets, he is sentenced to death. prison for 10 months", added the judge.

The verdict is lower than the demands of the KPK public prosecutor (JPU) who requested that Sri Utami be sentenced to 4 years and 3 months plus a fine of IDR 250 million subsidiaries 3 months confinement plus the obligation to pay compensation amounting to IDR 2,398 billion subsidiaries 1 year.

Sri Utami is the former Head of the Transfer, Abolition, and Utilization of State Property (P3BMN) at the State Property Management Center at the Secretary-General of the Ministry of Energy and Mineral Resources.

In her actions, Sri Utami was deemed proven to have received IDR 2,398 billion of money with IDR 1,498 billion of receipts from the Socialization Activities in the Energy and Mineral Resources Sector for Subsidized Fuel Oil for the Fiscal Year 2012 and IDR 900 million in receipts from the Healthy Bike Activities in the Context of Energy Saving Socialization in 2012.

All of Sri Utami's actions cost the state IDR11,124 billion.

Sri Utami was appointed by the former Secretary-General of the Ministry of Energy and Mineral Resources, Waryono Karno, seeking funds taken from various activities of the Secretariat General of Energy and Mineral Resources.

These activities are, first, the socialization of the energy and mineral resources sector of subsidized fuel oil (BBM) in 2012. The socialization activity with a budget of IDR 5,309 billion was divided into 48 activities with a value of around IDR 100 million.

The total money collected from the activities was IDR 2,964 billion which was delivered to Sri Utami, then Sri Utami used IDR 1,465 billion for activities at the Secretariat General that were not funded by the APBN, among others, to be given to NGOs, community organizations, Paspampres, Holiday Allowances, journalists, "office boy", travel, vehicle registration renewal, office operations, and more.

The rest of the money was divided between Poppy Dinianova (IDR 148 million), Jasni (IDR 156.224 million), and Teuku Bahagia (IDR 120.4 million), working capital (IDR 100 million).

Second, the healthy bicycle activity in the context of energy-saving socialization in 2012 with a total budget of IDR4.175 billion was divided into 43 activity packages with a value of under IDR100 million.

The money amounting to IDR1.1 billion was then handed over to Sri Utami for the activities of the Secretariat General of Energy and Mineral Resources which were not funded by the APBN while the rest was received by Poppy (IDR437.6 million), Jasni (IDR318.469 million), Dwi Purwanto (IDR15 million), Bambang WIjiatmoko (IDR20 million), Johan (IDR1.034 billion).

Third, maintenance of the ESDM Secretariat office building for the Fiscal Year 2012 worth IDR37.817 billion for the renovation of 3 buildings, namely the Secretariat General of the Ministry of Energy and Mineral Resources (Plaza Centris) Building on HR Rasuna Said Street, South Jakarta (IDR1.83 billion); Secretariat General of the Ministry of Energy and Mineral Resources, Pegangsaan Timur Street No. 1A Cikini, Central Jakarta (IDR2,693 billion); and the Secretariat General of the Ministry of Energy and Mineral Resources, Medan Merdeka Selatan Street No. 18, Central Jakarta (IDR7.968 billion).

The renovation work of the three buildings was also divided into small maintenance packages, namely into 142 packages by borrowing several companies to act as if they were carrying out the work with a "fee" of borrowing 2-5 percent of the project value.
