4 Defendants Of Corruption For Procurement Of Rp. 3.4 Billion Of Cows Sentenced To Free At The Aceh Corruption Court

BANDA ACEH - The panel of judges at the Banda Aceh Corruption Court has acquitted four defendants for alleged corruption in the procurement of cattle at the Livestock Service Office of Aceh Province with a value of Rp. 3.4 billion.

The verdict was read out by a panel of judges chaired by Nani Sukmawati accompanied by Sadri and Dedi Harianto respectively as member judges at the trial at the Banda Aceh Corruption Court, Tuesday, June 7.

The four defendants are Alimin Hasan, Ichwan Perdana, Kuswandi, and Surya. The defendants were present accompanied by legal counsel Junaidi and his friends. The Public Prosecutor (JPU) Zilzaliana was also present.

In its decision, the panel of judges stated that the defendants were not proven guilty of committing a criminal act of corruption as indicted by the Public Prosecutor. Because, the defendants were acquitted of all charges and charges.

"The defendants were not legally and convincingly proven guilty of committing a criminal act of corruption as in the indictment of the public prosecutor, whether primary, subsidiary, or more subsidiary," said the panel of judges as reported by Antara.

In their consideration, the panel of judges stated that the procurement of 225 cattle at the Livestock Service Office of Aceh Province for the 2017 fiscal year worth Rp. 3.4 billion was in accordance with the specifications and work contracts.

According to the panel of judges, when the 225 cows were handed over they were in good health. And it has been proven by a veterinarian's statement that all the cows are healthy, not sick.

The verdict does not match the prosecutor's demands. At the previous trial, the Public Prosecutor demanded Alimin Hasan as the Budget User Proxy and Ichwan Perdana as the Technical Implementing Officer for cattle procurement activities at the Livestock Service Office of Aceh Province for seven years and six months each. In addition to imprisonment, the Public Prosecutor also demanded a fine of Rp. 300 million, a subsidiary of six months in prison.

Meanwhile, against the defendants Kuswandi and Surya, the Public Prosecutor demanded a sentence of eight years and six months in prison. The Public Prosecutor also demanded that the two executors of the procurement pay a fine of Rp. 300 million, a subsidiary of six months in prison.

In addition, the public prosecutor also demanded that the defendants Kuswandi and Surya pay compensation for state losses amounting to Rp1.23 billion. If the defendant does not pay the replacement money, he will be sentenced to four years in prison.

Based on the decision of the panel of judges, the public prosecutor appealed to the Supreme Court. Meanwhile, the defendant and his legal advisor stated that they accepted the verdict.
