KPK Transfers Case Files To The Inactive Langkat Regent To Court
JAKARTA - The Corruption Eradication Commission (KPK) has transferred the case files of five defendants suspected of bribery related to the procurement of goods and services in 2020-2022 in Langkat Regency to the Jakarta Corruption Court (Tipikor).
The five defendants were the recipients of bribes, namely the inactive Langkat Regent Terbit Plan Warin Angin, Iskandar PA as the Village Head of Balai Kasih and also Terbit's siblings and three private parties or contractors, each Marcos Surya Abdi, Shuhanda Citra, and Isfi Syahfitra.
"Today, the KPK prosecutor Zainal Abidin has transferred the case files along with the indictment of the defendants to the Corruption Court at the Central Jakarta District Court," said Plt. KPK spokesman Ali Fikri was quoted by Antara, Tuesday, May 31.
Furthermore, their detention is under the authority of the Corruption Court.
"The team of prosecutors is still waiting for the issuance of the determination of the appointment of the panel of judges and the determination of the day of the trial with the initial agenda of reading the indictment," he said.
They were charged with the first indictment of Article 12 letter (a) or Article 12 letter (b) of the Anti-Corruption Law in conjunction with Article 55 paragraph (1) of the 1st Criminal Code jo. Article 65 paragraph (1) of the Criminal Code or both Article 11 of the Anti-Corruption Law jo. Article 55 paragraph (1) of the 1st Criminal Code jo. Article 65 paragraph (1) of the Criminal Code.
The KPK has named a total of six suspects. The giver of the bribe is Muara Warin Angin from a private party or contractor who is currently a defendant and is in the trial process at the Jakarta Corruption Court.
In the construction of the case, the KPK explained that Terbit as the Regent of Langkat for the 2019-2024 period together with Iskandar allegedly arranged for the implementation of the infrastructure work project package in Langkat Regency for personal interests.
In making this arrangement, Terbit ordered Sujarno as Plt. The Head of the Langkat Regency PUPR Service and Suhardi as the Head of the Procurement of Goods and Services to actively coordinate with Iskandar, as the Publisher's representative, regarding the selection of which party will be appointed as the winner of the project work package at the PUPR Service and the Education Office.
In order to be the winner of the work project package, the KPK suspects that there is a request for a percentage or fee by Terbit through Iskandar of 15 percent of the project value for the work package through the auction stage and 16.5 percent of the project value for the direct appointment package.
Furthermore, one of the partners who was selected and won to work on the project in the two services was the suspect Muara using several company flags. The total value of the project package that was carried out was Rp. 4.3 billion.
Apart from being carried out by partners, there are also several projects carried out by Terbit through Iskandar's company.
Muara allegedly gave the fee in cash in the amount of around Rp. 786 million, which was received through Marcos, Shuhanda, and Isfi to be then given to Iskandar and forwarded again to Terbit.
The KPK suspects that in receiving and managing fees from various projects in Langkat Regency, Terbit uses trusted people, namely Iskandar, Marcos, Shuhanda, and Isfi.
