Customer Money Lost Rp5.8 Billion, Kudus District Court Judge Orders Bank Mandiri To Compensate

KUDUS - The Kudus District Court, Central Java, granted a claim by a Bank Mandiri customer who lost money in a Bank Mandiri savings account worth Rp. 5.8 billion.

The chairman of the Kudus District Court Singgih Wahono said the lawsuit was filed by a customer of Bank Mandiri, Moch Imam Rofi'i. While the defendant PT Bank Mandiri.

The lawsuit filed by the applicant, he said, was only partially granted, while the defendant's exception was rejected in court.

In the main case, he said, the judge partially granted the plaintiff's claim, stating that the defendant had committed an unlawful act.

"Punishing the defendant to pay the loss suffered by the plaintiff for the account burglary of Rp. 5.8 billion," he said, quoted by Antara, Wednesday, May 25.

Meanwhile, the court costs incurred in the case amounting to Rp. 399,500 were charged to the defendant.

Based on this decision, the parties have the right to determine their attitude. If you accept the decision, you will be declared inkrah, whereas if you don't accept the decision, there will be an appeal within 14 days of the verdict being pronounced.

Meanwhile, the plaintiff's attorney, Nur Sholikin, said he was grateful that in today's trial at the Kudus District Court today (25/5) which was held online (e-court) led by Singgih Wahono, partially granted the lawsuit.

"Alhamdulillah, the main point of the case was granted. Among them were related to unlawful acts, in the verdict the defendant was declared to have committed an unlawful act, then the defendant also had to return the customer's funds," he said.

The trial, he said, was quite long because it lasted for 7 months because each party had rights.

The lawsuit that was not granted by the panel of judges was related to immaterial claims and confiscation of guarantees, while notification of whether there was an appeal from the defendant waited 14 days, namely until June 15, 2022.

The client found out about the loss of funds in the savings account on May 31, 2021 when they wanted to withdraw cash at Bank Mandiri Karanganyar Branch, Demak for Rp. 20 million, but as information from the teller the client's ATM card was blocked and it was suggested to replace the ATM card at Bank Mandiri Kudus Branch Office.

After the ATM card processing was completed, the client made a withdrawal of Rp. 20 million, but the remaining balance in the passbook was only Rp. 128.68 million, the balance should have been Rp. 5.95 billion.
