Proven Corruption, 10 Members Of Muara Enim DPRD Inactive Sentenced To 4 Years In Prison

PALEMBANG - The panel of judges at the Palembang District Court, South Sumatra, sentenced 10 members of the Muara Enim Regency DPRD to inactive with a prison sentence of four years for a corruption case in the procurement of goods and services at the local PUPR Service for the 2019 Fiscal Year.

The inactive members of the Muara Enim DPRD are Indra Gani, Ishak Joharsah, Piardi, Subahan, Mardiansah, Fitrianzah, Marsito, Muhardi, Ari Yoca Setiaji, and Ahmad Reo Kesuma.

"Trial the defendants with a prison sentence of four years, a fine of Rp. 200 million, with the condition that if they are not paid, they will be replaced with an additional month's imprisonment," said Chief Justice Efrata Happy Tarigan in a verdict at the Palembang District Court. Wednesday, May 25.

In addition, the judge required the defendants to pay replacement money, including Rp. 300 million, Rp. 250 million and Rp. 200 million, not later than one month.

"This includes providing additional punishment in the form of revocation of the right to vote and being elected for 2 years after the main criminal period of the defendants is completed," he said reading out the verdict.

The judge explained that the sentence given was based on the examination of witness statements in the trial and supported by evidence, the defendants were proven to have committed a criminal act of corruption together and continued as the first alternative indictment from the KPK Public Prosecutor.

The defendants were proven to have received gifts or promises totaling Rp.2,360 billion as part of the realization of the 15 percent "fee" commitment in the work plan for 16 project packages at the Muara Enim PUPR Office for the 2019 budget year, sourced from Robi Okta Pahlevi (as the contractor).

This corruption was carried out by the defendants together with Ahmad Yani (former Regent of Muara Enim), Ramlan Suryadi (former Acting Head of the Muara Enim PUPR Service), A. Chairman of the Muara Enim DPRD), Juarsah (former Acting Regent of Muara Enim) up to 16 project packages were obtained by Robi Okta Pahlevi.

"The gift or promise is given so that the defendants do or not do something that is contrary to their obligations as members of the DPRD, in order to carry out the affairs of the project, they are interrelated with each other (with officials who have been sentenced to criminal decisions and have resigned), ' said the judge.

For this action the 10 inactive members of the DPRD Muara Enim have violated Article 12 letter a of Law Number 31 of 1999 which has been changed to Law Number 20 of 2001 concerning the Eradication of Corruption Crimes Jo. Article 55 paragraph (1) of the Criminal Code.

"The aggravating things that the defendant did are not in line with the government's program in eradicating corruption, this act has harmed the public's trust. Ordered the defendants to remain in detention (Pakjo class IA Palembang detention center)," said the judge, given seven days forward to the defendants through their respective legal advisers to decide whether to accept or appeal the verdict.
