Defendant In OTT Case Cost Of Land Certificate Fisherman Sued 4 Years In Prison
MATARAM - Prosecutors demanded that the judge sentenced Defendant Hazairin who was involved in the Operation Catch Hand (OTT) case for the cost of issuing land certificates for fishermen in the Teluk Awang area, Central Lombok Regency, West Nusa Tenggara, for four years in prison.
"Demanding the panel of judges to participate in imposing a fine of Rp. 200 million for the defendant, with a subsidiary of two months in prison," said public prosecutor Reta Rusyana before the panel of judges at the Mataram Corruption District Court.
The claim for the former Head of the Capture Fisheries Section at the Marine and Fisheries Service of Central Lombok was asked by the public prosecutor to be proven according to the contents of the indictment Article 12e or Article 12a of Law No. 20/2001 on Amendments to Law No. 31/1999 on Eradication of Acts Corruption Crime.
The prosecutor applied the demands of the article in accordance with the facts revealed in the trial, namely the abuse of authority and the defendant's participation in illegal levies (extortion) in the issuance of land certificates for fishermen.
In the indictment, the prosecutor explained that the issuance of land certificates for fishermen was included in the Healthy Fisherman program in 2020, the result of collaboration between the Maritime Affairs and Fisheries Service and the National Land Agency (BPN).
The purpose of this program is to make it easier for fishermen to get a loan at a bank by making the land certificate as collateral.
In this case, the defendant was caught in the act of arresting the head of Hamlet Awang Asem Sukardi, who is also still undergoing the trial process.
Sukardi was arrested by Central Lombok Resort Police personnel for withdrawing money among land certificate recipients. The value of the money confiscated from Sukardi's arrest, reached Rp. 6 million. The money has now been returned to the rightful owner.
After hearing the prosecutor's demands, the Panel of Judges led by Irlina then set a follow-up trial next week with the agenda of reading a memorandum of defense (pleidoi) according to the defendant's submission through legal counsel.
