PKS Asks Jokowi To Issue A Perppu To Revoke The Work Creation Law

JAKARTA - DPR RI PKS Faction member Hidayat Nur Wahid has asked President Joko Widodo to issue a government regulation in lieu of a law (perppu) to revoke the Job Creation Law.

This is because the Job Creation Law has received a lot of resistance from various elements of society such as workers and students. This can be seen from the wave of demonstrations that have been running from 6 October until today.

"It would be wise for President Jokowi to use his constitutional authority to immediately issue a Perppu to revoke the Omnibus Law on the Work Creation Bill, so that everything is returned to the existing Law," Hidayat said in a written statement, Thursday, August 8.

However, if Jokowi does not take steps to issue a perppu, Hidayat supports if there are trade unions, labor organizations, NGOs, mass organizations, and individuals to exercise their constitutional rights by submitting a judicial review to the Constitutional Court (MK).

"And the Constitutional Court should really carry out its obligations fairly and correctly, for the sake of saving NKRI as a Pancasila state and a rule of law," he said.

PKS reasons for rejecting the Job Creation Law

Hidayat said that his party had a number of reasons not to side with the supporters of the ratification of the Job Creation Law. Hidayat assessed that there were irregularities in the formality aspect of the formation of laws by the government and the majority of factions in the Legislation Body (Baleg) of the DPR RI in a plenary meeting of the ratification of the Job Creation Law.

"During the decision-making level I at Baleg and level II at the Plenary Meeting, the complete and final drafts of the bill have not been distributed to all factions. Surprisingly, all factions in the DPR have been asked to express their opinion," said Hidayat.

The deputy chairman of the MPR RI said that the discussion of the Job Creation Bill before it was passed was also very hasty. This can be seen from the schedule for the ratification of the bill in the DPR plenary session which suddenly moved forward, from the 8th to the 5th October.

In terms of substance, Hidayat said there are many problematic substances in the law. One of them, this law tends to foreign investment and is detrimental to the interests of the workers of Indonesian citizens, especially workers or laborers

"The problem of investing in Indonesia is not actually a matter of regulatory changes, but about rampant KKN and bureaucratic inefficiency. That should be a priority focused on by the government," Hidayat explained.

He also considered that the Job Creation Law did not provide legal certainty. Initially, this law was presented to provide legal certainty and simplify regulations, but the opposite happened.

"Unfortunately, this law actually mandates many provisions to be regulated in government regulations (PP), so that making regulations does not become simple, and full of political speculation," he concluded.
