After Leaving The KPU Commissioner, Wahyu Setiawan Is Languishing In The Guntur Prison
JAKARTA - The General Election Commission (KPU) commissioner Wahyu Setiawan has been named a suspect in the bribery case by the Corruption Eradication Commission (KPK). However, Wahyu has not been removed from his position as election organizer.
In the midst of handling the KPK, Wahyu realized his mistake. Through a piece of paper he wrote at the KPK's Red and White House, South Jakarta, Wahyu declared his resignation from the position of Commissioner of the KPU.
He made this statement after wearing the orange vest typical of KPK detainees. A piece of resignation paper was held in the handcuffed hand.
"With me being declared a suspect, I will immediately resign as a member of the KPU," said Wahyu at the KPK's Red and White House, Friday, January 10 in the early hours of the morning.
For the act of abusing his position as election organizer, Wahyu apologized to the Chairperson, Members (Commissioner), and Secretary General of the KPU. Wahyu also apologized to all KPU ranks throughout Indonesia.
"This incident is purely my personal problem and I respect the legal process being carried out by the KPK," he said.
"Please pray, hopefully I will be given health and patience," he continued.
Currently, Wahyu has left the KPK's Red and White House. Now, Wahyu has been detained at the Guntur Detention Center (Rutan). Meanwhile, other suspects, namely Agustiani Tio Fridelina and Saeful were detained at the KPK detention center. One more suspect, Harun Masiku is still at large.
Previously, KPU Chairman Arief Budiman explained, according to the rules of Law Number 7 of 2017, a new KPU member will be temporarily suspended if he is already a defendant.
"According to the provisions of laws and regulations, the election organizer or member of the KPU, provincial KPU or regency / city KPU. If he has been named a defendant, he will be suspended temporarily," said Arief at the KPK Red and White Building, South Jakarta, Thursday January night.
"Then this is until there is a verdict with permanent legal force. If he is guilty, he will be permanently dismissed. If he is not guilty, he will be rehabilitated," he continued.
However, seeing this case affect the level of public trust and allow the delegitimization of election organizers, Arief said that his party would hold a plenary session to determine the status of Wahyu Setiawan from the KPU commissioner.
"Because this case is quite important for us and affects public confidence in the election organizers, we will hold a plenary meeting," said Arief.
For information, KPU commissioner Wahyu Setiawan was officially named a suspect in receiving bribes by the KPK. Wahyu was proven to have asked for Rp900 million in cash.
The money will be used to pave the way for the DPR RI candidates from the PDIP. Harun Masiku gets his share of the nomination through the interim replacement process (PAW) from Nazarudin Kiemas who died. In fact, the KPU held a plenary meeting and appointed another legislative candidate named Riezky Aprilia as a replacement for Nazarudin.
For the actions of Wahyu and Agustiani who accepted bribes, then they are suspected of violating Article 12 paragraph (1) letter a or b or Article 11 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1st Criminal Code.
Meanwhile, Harun and Saeful were later suspected of violating Article 5 paragraph 1 letter a or b or Article 13 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) to -1 KUHP.
