Setiawan's Revelation Who Betrayed The Democratic Process
JAKARTA - The commissioner of the General Election Commission (KPU) Wahyu Setiawan was officially named a suspect in accepting bribes by the KPK. Wahyu was proven to have asked for Rp900 million in cash.
The money will be used to pave the way for the DPR RI candidates from the PDIP. Harun Masiku gets his share of the nomination through the interim replacement process (PAW) from Nazarudin Kiemas who died.
Deputy Chairman of the Corruption Eradication Commission Lili Pantauli explained, in early July 2019, one of the PDIP DPP officials ordered an advocate named Doni to file a judicial review suit for Article 54 of KPU Regulation Number 3 of 2019 concerning Voting and Counting of Votes. This material lawsuit filing is related to the death of Nazarudin.
This lawsuit was later granted by the Supreme Court (MA) on July 19, 2019. The Supreme Court determined that the party determines the votes and replaces them between time. PDIP then sent a letter to the KPU to appoint Harun as a replacement for the deceased candidate.
"However, on August 31, 2019, the KPU held a plenary meeting and appointed another candidate named Riezky Aprilia as a replacement for Nazarudin Kiemas," said Lili at a press conference at the KPK's Red and White House, South Jakarta, Thursday, January 9.
Two weeks later, a private party named Saeful, who has an interest in Harun, lobbied Wahyu Setiawan to be able to pass Harun to replace Riezky as a legislative candidate approved by the KPU.
Wahyu also agreed to help her escape by replying, "Ready, play!". This is where Wahyu committed the criminal act of corruption by asking for operational funds of Rp. 900 million. Money was given in stages.
"In mid-December 2019, one of the sources of funds (being investigated by the KPK) gave Rp. 400 million to Wahyu," said Lili.
The money was handed over to Wahyu's closest person, namely a former member of the Election Supervisory Agency, Agustiani Tio Fridelina. Agustiani gave Rp. 200 million to Wahyu at a shopping center.
Then, at the end of December 2019, Harun deposited Rp.850 million to Saeful to make his way to becoming a replacement candidate. This money is divided among several people.
Around IDR 150 million was handed over to Doni, the advocate who initially submitted a judicial review to the Supreme Court. The remaining Rp. 700 million is divided into Rp. 450 million to Agustiani, then the remaining Rp. 250 million is for operations.
Wahyu also received his share of Rp. 400 million. However, Agustiani did not give the bribe immediately, but was kept first by Agustiani. However, in the process, on Tuesday, January 7, it turned out that the KPU held a plenary meeting to continue to reject the PDIP request to assign Harun.
However, Wahyu did not give up. "Wahyu then said that he had received the money and would try again so that Harun became PAW," said Lili.
Until finally, on Wednesday, January 8, 2020, the KPK conducted OTT to Wahyu and Agustiani who were at Soekarno Hatta Airport securing evidence of Rp400 million in cash in Agustiani's hands in Singapore dollars.
For the actions of Wahyu and Agustiani who accepted bribes, then they are suspected of violating Article 12 paragraph (1) letter a or b or Article 11 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1st Criminal Code.
Meanwhile, Harun and Saeful were later suspected of violating Article 5 paragraph 1 letter a or b or Article 13 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) to -1 KUHP.
