Banjarmasin Prosecutor's Office Apply Restorative Justice To Ahmad Fahrizal Who Beats His Friend Because Of Drinking Alcohol
BANJARMASIN - The District Prosecutor's Office (Kejari) of Banjarmasin, South Kalimantan, has implemented restorative justice or restorative justice to free a perpetrator who has been caught in a persecution case.
"The case of Article 351 Paragraph (1) of the Criminal Code on behalf of the defendant Ahmad Fahrizal was suspended after the exposure results were approved by the Jampidum AGO because a number of criteria were met," said Head of the General Criminal Section (Kasi Pidum) of the Banjarmasin Kejari Roy Modino in Banjarmasin, as reported by Antara, Thursday, April 21.
The mediation stage facilitated by the prosecutor succeeded in achieving peace between the perpetrator and the victim so that restorative justice could be applied.
Roy explained that representing the Kajari Banjarmasin Tjakra Suyana Eka Putra, the defendant had committed a crime for the first time, then the crime committed was threatened with imprisonment of not more than 5 years and there was a peace agreement between the victim and the defendant.
Previously, the defendant was detained for approximately two months at the South Banjarmasin Polsekta after being a suspect in the case of assaulting victim Abdul Khair, a resident of Jalan Tatah Bangkal Luar, Kelayan Timur, South Banjarmasin.
"The two of them were friends since childhood. Only because of the influence of alcohol, there was a beating incident that caused the victim to suffer facial injuries," said Roy accompanied by the Head of the Intelligence Section, Dimas Purnama Putra.
Fahrizal said he was happy and grateful that he was finally free thanks to the restorative justice applied by the prosecutor. He also received advice not to repeat his mistakes again, because the settlement of cases through restorative justice can only be carried out on perpetrators who have committed a crime for the first time.
"I promise not to consume alcohol anymore. Moreover, drugs should not be allowed because if there is no restorative justice case, the prosecutor said," he said.
