Entrepreneurs Be Careful, Not Paying THR 2022 Can Be Sanctioned With Freezing Business Permits

JAKARTA - The Ministry of Manpower (Kemenaker) has warned companies to pay the 2022 holiday allowance (THR) obligations to workers and laborers. Because, if you don't pay or pay late, there will be sanctions. In the latest regulation, THR must be paid on the 7th of Eid 2022.

Director General of Labor Supervision, Occupational Safety and Health (Binwasnaker) Haiyani Rumondang said that Article 79 of Presidential Regulation Number 36 of 2021 concerning Wages states that companies will be subject to gradual administrative sanctions.

"There will be administrative sanctions in stages. First, a written warning, restrictions on business activities, temporary suspension of part or all of production until business activity freezes," he said in a virtual press conference, Friday, April 8.

The details related to the administrative sanctions are first, a written warning to the entrepreneur for violating or not making payments according to the provisions.

Meanwhile, said Haiyani, restrictions on business activities are restrictions on the production capacity of goods and services that cannot be fully operational within a certain time.

"So there are records at a certain time," he said.

Then, continued Haiyani, the other stage is the delay in granting a business license in one location or several locations of companies that have projects or activities.

"The stages are up to a temporary suspension. These are some elaborations of the sanctions," he said.

To reach these stages, said Ida, the person concerned needs to make a complaint to the THR 2022 Command Post and provide a chronology as proof that the company does not give rights to employees or workers.

"Later, this labor inspector will carry out a process. So from the post it will be submitted to the (provincial) manpower office," he concluded.
