KPK Jails Edhy Prabowo To Tangerang Prison
JAKARTA - The Corruption Eradication Commission (KPK) executed former Minister of Maritime Affairs and Fisheries Edhy Prabowo. The convict in the lobster seed export bribery case was sent to Tangerang Class I Lapas to serve his sentence.
"The convict was admitted to the Tangerang Class I Penitentiary to serve a five-year prison term minus the detention period since the investigation stage," said Acting KPK Spokesperson for Enforcement Sector Ali Fikri in a written statement, Wednesday, April 6.
Ali said the execution was carried out by the KPK Execution Prosecutor Hendra Apriansyah on Tuesday, April 5.
The basis for the execution was the decision of the Corruption Court at the Central Jakarta District Court Number: 26/Pid.Sus-TPK/2021/PN. Jkt. Pst dated 15 July 2021 in conjunction with the Corruption Court's Decision at PT DKI Jakarta Number: 30/Pid.Sus-TPK/2021/PT. DKI dated November 1, 2021 in conjunction with Supreme Court Decision Number: 942K/Pid.Sus/2022 dated March 7, 2022.
Furthermore, Edhy Prabowo is required to pay a fine of Rp. 400 million with the condition that if it is not paid, it will be replaced with imprisonment for six months.
Then, the former Gerindra Party politician was also required to pay replacement money of Rp. 9.6 billion and US$77 thousand, taking into account the returns that had been made.
"If the convict does not pay within one month after the court's decision has permanent legal force, then his property is confiscated by the Prosecutor and auctioned to pay the replacement money and in the event that his assets are insufficient, he is sentenced to three years in prison," he said.
After being released, Edhy will also carry out an additional sentence in the form of revocation of the right to be elected in public office for two years.
Previously, the Supreme Court reduced Edhy Prabowo's sentence from 9 years to 5 years in prison. In its consideration, the cassation panel said the former minister had done a good job.
This decision was approved by the assembly consisting of Sofyan Sitompul, Gazalba Saleh, and Sinintha Yuliansih Sibarani on 7 March.
As for the intention of working well during his tenure, because Edhy revoked the Minister of Marine Affairs and Fisheries Regulation Number 56/PERMEN-KP/2016 dated December 23, 2016 and replaced it with the Minister of Marine Affairs and Fisheries Regulation Number 12/PERMEN-KP/2020 which aims to utilize lobster seeds. .
"That is, they want to empower fishermen and also to cultivate them because lobster in Indonesia is very large. Furthermore, in the Minister of Maritime Affairs and Fisheries Regulation Number 12/PERMEN-KP/2020, exporters are required to obtain lobster clear seeds (BBL) from small fishermen who catch BBL," taken from the consideration of the appeal.
"So it is clear that the defendant's actions are for the welfare of the community, especially small fishermen," added the consideration of the cassation panel.
