AGO Determines Completeness Of Case Files For Alleged Bribery Red Notice This Week

JAKARTA - The investigating prosecutor at the Attorney General's Office (Kejagung) will hold an investigation file for the alleged red notice bribery case that has been handed over by Bareskrim Polri.

Head of the Attorney General's Office of Legal Information, Hari Setiyono, said the results of the case title will decide whether or not the investigation files are complete.

"Research is being carried out and the information is carried out this week an internal case will be conducted by the public prosecutor on the completeness of the case files," Hari told reporters, Wednesday, September 30.

If the results of the case title are declared complete, the prosecutor will coordinate with Bareskrim investigators for phase two. Stage two means the handover of evidence and the suspect for immediate trial.

"Is P21 or returned again and usually the public prosecutor always coordinates with investigators. If there are deficiencies that are not too principle, it is usually done in coordination," he explained.

Meanwhile, when he was asked about the existence of a pretrial lawsuit filed by Inspector General Napoleon Bonaparte in the case, Hari emphasized that this would not affect the process of transferring the investigation files.

"I think pretrial with case files is a different matter. The pretrial filed by NB, is his right. But the case files are already in process," he said.

Previously it was reported that Bareskrim Polri investigators completed the completeness of the investigation files for the red notice case of Djoko Tjandra and other suspects. The case files will be transferred back to the investigating prosecutor at the Attorney General's Office (AGO).

"The files for the alleged corruption case (with suspects) JST, NB and PU today, Monday, September 21, 2020, the planned files will be sent back to the prosecutor," said Karo Penmas, Police Public Relations Division, Brigadier General Awi Setiyono to reporters, Monday, September 21.

Investigators at the Corruption Crime Directorate, Bareskrim Polri, have completed several shortcomings after coordinating with the Public Prosecutor (JPU). The National Police Headquarters previously handed over this file on Thursday, September 3.

In the case of alleged bribery for the removal of red notices, investigators have named four people as suspects. They are Inspector General Napoleon Bonaparte and Brigadier General Prasetyo Utomo as suspects because they are suspected of being the recipients of bribes for the removal of red notice.

Both of them were charged with Article 5 Paragraph 2, Article 11 and Article 12 letters a and b of Law Number 20 of 2020 concerning Corruption (Tipikor) in conjunction with Article 55 of the Criminal Code.

Meanwhile, Tommy Sumardi and Djoko Tjandra were named as suspects on suspicion of giving bribes. Both of them were charged under Article 5 Paragraph 1, Article 13 of Law 20/2020 concerning Corruption (Tipikor) in conjunction with Article 55 of the Criminal Code.

In the bribery case, investigators confiscated US $ 20 thousand, cellphones, including CCTV as evidence.
