Case Of Persecution In Manado With Perpetrator Brian Terok Stopped, Manado Kejari Implements Restorative Justice
JAKARTA - The Deputy Attorney General for General Crimes (Jampidum) agreed to stop the prosecution of cases based on a restorative justice approach from the Manado District Attorney (Kejari) in North Sulawesi related to cases of abuse.
Head of the North Sulawesi High Prosecutor's Office (Kajati) Edy Birton in Manado, explained that he had carried out a virtual exposure of restorative justice cases with the Jampidum of the Indonesian Attorney General's Office.
"The restorative justice case comes from the Manado Kejari, namely the case of a criminal act of persecution on behalf of the suspect Brian Terok who is suspected of violating Article 351 Paragraph (1) of the Criminal Code," he said through the Head of Penkum, Theodorus Ruampak, Tuesday, March 22, quoted from Antara.
The exposure was carried out by Assistant for General Crimes Jeffry Paultje Maukar, accompanied by Coordinator Anthoni Nainggolan, Kasi Oharda Cherdjariah, and Kasi Penkum Theodorus Ruampakk.
From the general criminal case that was carried out by the exposure, Jampidum Fadil Zumhana gave his approval for restorative justice to be carried out and the prosecution will then be terminated by the Manado Kejari.
The criminal case can be closed by law and prosecuted based on restorative justice because it has fulfilled the requirements for restorative justice.
Admittedly, the conditions for restorative justice on cases on behalf of the suspect Brian Terok include, among others, that the suspect has committed a crime for the first time.
The crime committed by the suspect is punishable by imprisonment of not more than five years.
The victim has forgiven the suspect and pleaded with the authorities so that the report made by the victim does not proceed to the court level and if in the future there are other parties who dispute it, it will be the responsibility of the victim and the community to respond positively.
This restorative justice was attended virtually by the Head of the Public Prosecutor's Office of Manado, Ester Sibuea and the Head of General Crimes Office of the Manado District Attorney's Office.
