Former Head Of Jiwasraya Investment Division Sued 18 Years In Prison
JAKARTA - The Head of Jiwasraya Investment and Finance Division 2008-2014 Syahmirwan was sentenced to 18 years in prison because he was considered guilty of corruption which caused losses to state finances worth Rp. 16.807 trillion.
"Demand that the defendant Syahmirwan is legally and convincingly guilty of committing several criminal acts of corruption as the primary indictment. Imposing a criminal sentence against the defendant in the form of a prison sentence of 18 years and a fine of Rp1 billion subsidiary to 6 months imprisonment," said the general prosecutor (JPU) of the Yanuar Attorney General's Office. The charges are based on the indictment of article 2 paragraph (1) in conjunction with article 18 of Law No. 31 of 1999 as amended by Law No. 20 of 2001 on Corruption Eradication in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
In the case, according to the prosecutor, there were seven acts committed by the three defendants together with the President Director of PT Hanson International Tbk Benny Tjokrosaputro, the President Commissioner of PT Trada Alam Minera Tbk Heru Hidayat and the Director of PT Maxima Integra Joko Hartomo Tirto.
First, Hendrisman Rahim, Hary Prasetyo and Syahmirwan entered into an agreement with Heru Hidayat, Benny Tjokrosaputro and Joko Hartono Tirto in managing the investment in shares and mutual funds of PT Asuransi Jiwasraya (AJS) which is not transparent and unaccountable.
Second, the management of stocks and mutual funds is carried out without analysis based on objective and professional data in the Head Office Internal Note (NIKP) but the analysis is only made a joint formality.
Third, Hendrisman, Hary and Syahmirwan also bought shares of BJBR, PPRO and SMBR that have exceeded the provisions stipulated in the investment guidelines, namely a maximum of 2.5 percent of the outstanding shares.
Fourth, the three defendants carried out transactions to purchase and / or sell shares of BJBR, PPRO, SMBR and SMRU with the aim of intervening in prices which ultimately did not provide investment returns and could not meet liquidity needs to support operational activities.
Fifth, the three defendants controlled 13 investment managers by forming a special mutual fund product for PT AJS so that Joko Hartono Tirto could control the management of financial instruments that are the "underlying" mutual funds of PT AJS.
Sixth, Henderisman, Hary and Syahmirwan continue to approve the purchase / sale transaction of 21 underlying mutual fund products managed by 13 managers who are affiliated parties of Heru Hidayat and Benny Tjokrosaputro even though in the end they did not provide investment returns and were unable to meet liquidity needs to support activities. company operations.
Seventh, Hendrisman Rahim, Hary Prasetyo and Syahmirwan have received money, shares and facilities from Heru Hidayat, Benny Tjokrosaputro through Joko Hartono Tirto in connection with PT AJS stock investment and mutual fund management cooperation from 2008 to 2018.
Regarding this case, the Managing Director of PT Asuransi Jiwasraya (Persero) 2008-2018 Hendrisman Rahim was charged with 20 years in prison while the Jiwasraya's Finance Director for the January 2013-2018 period Hary Prasetyo was sentenced to 20 years in prison.
