Actor Dwi Sasono Is Charged With 9 Months Of Rehabilitation In Prison For Marijuana
JAKARTA - Actor Dwi Sasono was charged with nine months imprisonment on the condition that he was obliged to undergo rehabilitation at RSKO Cibubur for the abuse of narcotics types of marijuana, by the public prosecutor (JPU).
"The defendant Dwi Sasono has been legally and convincingly proven to have committed no narcotics crime, namely as a class 1 narcotics abuser for himself as regulated and punishable under Article 127 paragraph 1 of Law Number 35 of 2009 concerning narcotics," said Prosecutor Donny M Sani. at the hearing to read out the demands at the South Jakarta District Court, it was reported by Antara, Wednesday, September 23.
In his indictment, the prosecutor considered that Dwi Sasono's actions had fulfilled the elements of the second alternative article in the public prosecutor's indictment, namely Article 127 paragraph 1 of Law Number 35 of 2009 concerning Narcotics.
According to the prosecutor, this charge also takes into account the statements submitted by witnesses who are arresters, as well as expert health and criminal witnesses presented by the defendant's legal advisor.
The prosecutor also considered things that incriminated the defendant, namely not supporting the government program in drug eradication.
Meanwhile, the things that relieve Dwi Sasono from being cooperative in the trial, regretted his actions and promised not to repeat them, and had never been convicted before.
On all considerations and facts proven at the trial, the prosecutor asks the panel of judges who examine and try the case to decide.
"First, declaring that the defendant Dwi Sasono has been legally and convincingly proven guilty of committing no crime of narcotics, namely as a class 1 narcotics abuser for himself as regulated and threatened with punishment in the second alternative indictment of public prosecutors," said Donny.
Second, continued Donny, sentenced the defendant Dwi Sasono to nine months imprisonment, minus the temporary detention period that has been served, provided that the period of treatment or treatment the defendant has served is counted as the period of serving his sentence.
"And the defendant underwent the remainder of the sentence by undergoing treatment or rehabilitation at RSKO East Jakarta," said Donny.
After the charges were read out, the Panel of Judges chaired by Judge Suharno asked Dwi Sasono's response to the prosecutor's demands. Dwi Sasono, through his legal advisor, stated that he would submit a pledoi (objection) to the prosecution's claim.
"After we hear the demands submitted, we think there are some shortcomings, so we will submit a pledoi," said M Aris Marasabessy.
The panel of judges then gave one week for legal adviser Dwi Sasono to prepare his objection note, so the trial was postponed next week on Wednesday, September 30.
