Reinforced By Expert Witness Statements, Indonesian Army Puspom Stops Investigation Of KSAD Dudung Case

JAKARTA - The TNI AD Puspom has terminated the alleged criminal act of blasphemy with the reported Chief of Army Staff (KSAD) General TNI Dudung Abdurachman. Based on the testimony of witnesses, evidence and expert testimony, this case is considered unable to proceed.

This was conveyed by the Head of Puspomad Agus Subur Mudjiono through an official statement received in Jakarta, Wednesday, February 23. Agus said that the Puspomad investigation team had conducted an investigation from 9-22 February 2022.

"By inviting reporters, witnesses and asking for information from criminal law experts from Airlangga University Surabaya, ITE experts from the Ministry of Communication and Information and two Indonesian language experts from the University of Indonesia (UI)," he explained.

Based on the testimony of criminal law experts, it was concluded that General Dudung Abdurachman's statement in the video published on Deddy Corbuzier's YouTube podcast, did not fulfill the subjective and objective elements.

As referred to in Article 156 of the Criminal Code, Article 156a of the Criminal Code, Article 14 and Article 15 of the Republic of Indonesia Law Number 1 of 1946 concerning Criminal Law Regulations, and Article 16 of Law Number 40 of 2008 concerning Racial and Ethnic Discrimination, as well as Article 27 paragraph (3) Jo. Articles 45 and 28 paragraph (2) Jo. Article 45 a paragraph (2) of Law Number 11 of 2008 concerning Information and Electronic Transactions as amended by Law of the Republic of Indonesia Number 19 of 2016 concerning amendments to Law of the Republic of Indonesia Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE).

The results of the ITE expert's statement also concluded that General Dudung Abdurachman's statement did not meet the elements of a criminal act," he explained.

"Similarly is the statement of the Indonesian language expert, who stated that the statement did not mean to equate God with humans or his creatures and did not contain the content of blasphemy which was alleged by the reporter Ahmad Syahrudin," therefore SP2 Lidik has been issued.
